(c) (1) In Montgomery County, the Board of Education may
negotiate with the employee organization designated as the
exclusive representative for the public school employees in a
unit, a reasonable service or representation fee, to be charged
nonmembers for representing them in negotiations, contract
administration, including grievances, and other activities as are
required under [§ 6-407] SUBSECTION (b) of this [article]
SECTION.

(4) An employee whose religious beliefs are opposed
to joining or financially supporting any collective bargaining
organization is:

(i) Not required to pay a service or
representation fee, and

(ii) Required to pay an amount of money as
determined in [paragraph] SUBSECTION (c)(2) OF THIS SECTION to a
nonreligious, nonunion charity or to such other charitable
organization as may be mutually agreed upon by the employee and
the exclusive representative, and who furnishes to the Board of
Education and the exclusive representative written proof of such
payment.

8-402.

(a) (1) The State and each county shall make free
educational programs available to each handicapped child,
including a child who is severely handicapped and an individual
eligible for compensatory special [educational] EDUCATION
services, as provided by this subtitle.

8-414.

(f) (3) If the State Superintendent finds that the proposed
parent surrogate is not qualified to represent the child in the
educational decision making process in accordance with subsection
(e) [or] OF this section, the Superintendent may:

(i) Request the public agency to propose
another parent surrogate who is qualified; or

(ii) Select and appoint a parent surrogate who
is qualified.

8-415.

(a) (3) The county board shall maintain a list of at least
10 hearing officers who:

(i) May be selected from the list of
State-approved hearing officers [provided for in paragraph] UNDER
SUBSECTION (b)(2) of this section; and

[(iii)] (II) Shall have a general knowledge of
the law relating to the placement of handicapped children.
