809 John Harwood This cause being ready for hearing and Ruled v last Court that it should come to a hearing Thomas Edmondson this Court it is therefore ordered that the Bill and aswer which follows in these words Viz.t be read Viz.t To his Excy John Seymour Esq her Majestys Governour & keeper of the Great Seale of Maryland Humbly Complaining sheweth that your dayly orat.r John Harwood of Dorchester County being Possessed of a Certain Tract of Land lying on the North side or Choptank River at the head of Kings Creek in Talbott County in his Righ as of fee a Certain Thomas Edmondson of Talbott County plant.r surviveing Ex.r of John Edmondson late of the same County Craftily Combineing with sundry other persons altogether unknowne to your orat.r and unconscionably Coveting to defeat your orat.r of his just right and pretentions thereto some years since brought an Ejectment in the provinciall Court pretending your orat.r had Trespassed and within a Tract of Land called Mount hope lying adjacent thereunto which said Tract of Mount hope belonged to the said John Edmondson the father of the said Thomas & descended to His Eldest son James and his heires The said Thomas Edmondson Extravigantly Insisting That your orat.rs Land were part of the said Tract of Mount hope to which action your orat.r appeared by his attorney and tooke upon him the defence of But the said Thomas Edmondson Craftily procureing the platt of the Land to be made upon a Certificate of Resurvey different from the originall Certificate and of later date so Extravigantly Extended his pretended bounds of Mount hope that Contrary to plain Evidence at the Winter assizes held for Talbott County Anno 1708 by amuseing the Jury he obtained a Verdict therefore & has had Judgment rendred thereon your orat.r Not having his attorney Present to plead his cause or make any objections to his the said Thomas Edmondsons unjust and illegall pretentions and dayly threatens to turne your orat.r out of his possession Contrary to all Right Equity and good Conscience all which unconscionable (Proceeding |
