783 Nevertheless one full Moyety thereof to his the said Edward Dorseys owne proper Use and disposall as in and by the same deed remaining on Record in the Said Towne Court proceedings relation being thereunto had may more at Large appear but does not beleive the same was Executed and Enrolled according to Law whereby to pass any Estate from the said Col Dorsey and this Defend.t does beleive the Compl.t to be heir at Law of his Brother Edw.d Dorsey who dyed without Issue And further saith that he is not seucible of the said Edward Dorseys Necessity for money in the year on 1704 but knoweth that on or about the year 1704 An Act of Assembly past to cut of the Intale or settlement of the said Houses and Lotts and to Enable Col Edward Dorsey to sell them for the use of his said Children but knows nothing of the Compl.ts Consent thereto Has heard and beleives Col Dorsey Conveyed the afd houses and Lotts to Charles Carroll and William Bladen Esqs and their heires and tooke the said Bladen's Bond dated december y.e 11.th 1704 Conditioned for the sum of one hundred and fifty pounds sterling at three severall paym.ts Viz.t fifty pounds at the departure of every of the then next three London Fleets to the said Col Dorsey his Ex.rs Adm.rs or Assignes And this defend.t saith that he knows nothing of the Note of forty pounds drawne by Col Dorsey M.r Bladen on cann he tell for what Consideration nor what promises the said Bladen made to pay the same but denying all Combination and Confederacy with all or any person or persons whatsoever saith that he never received any part of the said purchase money nor did he ever heat that his wife Margarett Ex.rx of Edward Dorsey received any part or parcell thereof in her widdowhood or that the said Bladen ever pretended he had paid any to them and this Defend.t further saith that he hath fully administred Col Dorseys whole Estate unless the afd Clayme from the said Bladen due by bond as afd to the said Col Dorseys Ex.rs & Adm.rs of one hundred and fifty pound which is Inventoryed in Col Dorseys Estate be decreed parcell thereof which he hopes this honble Court will see fitt to do the said Col Dorsey having made ample satisfaction to his Children for what he had Intended them by the afd Deed of Trust to his Brother Cap.t John Dorsey afd by severall devisees in his the Col Dorseys last will and Testament and this Defend.t saith that the honble the Comitted for laying the (Publick |
