       Tract of Land who being sworne upon the holy Evangelist
       Concerning his knowledge of the premises saith as followeth

                                  The Deposition of Col Ninian Beale

       Col Ninian Beale aged about Eighty six Years being Sworne as above
       sayeth that the Tract of Land formerly laid out by him when Surv.r
       for Francis Swinsen called the Free School farme then lying in
       Prince Geo Calvert County but now in this County and on the West
       Side of the Westerne Branch of Putuxent River Joynes the West
       End of a Tract of land belonging to Alexander Magruder & begunn at
       a Marked oak being the South West Corner Tree of the Said Alex.r
       Magruders Land and in the Line of M.r Robert Carvills Land which
       oake being downe and seeming to lye burnt near the place a Ceeder
       post with sixteen Notches was now sett downe near the place where
       twas supposed to stand and Running with the said Line West three
       hundred and Twenty perches in Length to a Marked oak in the Same
       Line of M.r Robert Carvills Land which being downe lakewase a Spanish
       Oak was not marked with Twelve knotches and then Running
       North one hundred Twenty five perches in breadth to a Marked oak
       in the Line of Osbornes Land which not being found a Spanish oak
       was now Marked with Eight knotches and then running East three
       hundred & Twenty perches in Length to a Marked Hiccory in the Line of
       Alexander Magruders Land afd which being downe a Hiccory was ^now^ Marked
       with six Notches and Running from thence with a streight Lyne
       to the said Ceeder post at the beginning Containing two hundred and
       fifty acres more or less according to the said Bells former Certificate
       at his laying out of the said Land and further he saith not

       Jurat die mese annoq supredit coram me   Patrick Hepburne   (S)

       The same day this Tract of Land was surveyed and bounded as above by Cap.t
       Archbald Edmondson according to the Certificate and Depo.n of the aboves.d
       Col Ninian Beale in the presence of the said Col Ninian Beale M.r Samuel
       Magruder M.r William Head M.r Charles Allen Charles Drury & four Young
       Boys Viz James Edmondson Bigger Head Thomas Clagett Jun.r & Rich.d
       Clagett Jun.r Besides Cap.t Cap.t Thomas Clagett and Doct.r Patrick Hepburn
       Comission.rs appointed for Examining Evidences about it the Truth
