                         Edmond Pryors Depositions v Renatus Smith et Anthony
                         Ivy

Maryland fs.t                                             December y.e 15.th 1709

       By virtue of a Comission to us directed from her Majestyes high
       Court of Chancery dated the fourth day of November last for Examineing
       Evidences on behalfe of Edmond Prior Comp.lt and Renatus Smith and
       Anthony Ivy Execut.rs of the last Will and Testament of Robert Smith
       late of Queen Anns County Esq.r deceased Defend.t wee doe therefore
       humbly certifie y.t By direccons of the said Prior are called before us
       Mary Molson who haveing first taken her Corporall Oath upon the
       wholly Evangelist made the following answ.r to the Interrogatories viz.t

First   Were you in any wise privy to any Contract made betweene Robert
       Smith Esq.r Deceased and Edmond Prior and Catherine of Wife concerning
       his the said Smiths purchasing the said Edmond and Catherines right
       of any Land decended to her by the death of her father Michaell Paul
       Vanderford

Answ.r   I was p.rsent when Robert Smith Esq.r and Edmond Prior had some
       Communication about fifty Acres of Land and remember that the said
       Edmond Prior Asked the said Smith about the payment of some Tobaco
       w.ch the said Smith said was paid and doe further remember that the
       said Edmond did then scruple the signeing a Bond because it was
       written by the said Smith but at last by perswasion he did and I was
       wittness thereto w.ch is the Bond now in dispute but I allwayes thought it
       to be for no more then fifty Acres of Land

                                              Feb.ry 9.th 1709/10

       By Virtue of the Comiss.n afores.d and by the direction afores.d wee called
       before us Coll Robert Finley and Jane his wife who first haveing taken
       their Corporall Oaths on the wholy Evangelist made the following answ.r
       to these Interrogatories vizt

first   To Coll Robert Smith ^Finley^ and his wife

       Did you ever receive from the hands of Robert Smith Esq.r any sume of
       Tobacco on Acc.t of a Judgment obteyned by Cap.t Richard Sweatnam late
       of Talbott County Deceased against Author Emory Jun.r for three Thous.d
       seven hundred and thirty seaven pounds of Tobacco debt and Cost and
       doe you find by any of the Bookes or other papers relateing to the s.d
