       Pounds of Toba in part of the bonds payable to the said Smith from the
       said Forbes amounting to the Sume of Thirty Seaven Thousand five hundred
       pounds of Tobaccoe  As alsoe that the said Forbes has paid to the said
       Smith five Thousand pounds of Toba formerly which with a bill of seaven
       Thousand Five Hundred Pounds of Toba payable to the sd Smith from
       the sd Forbes dated May the Sixth Sixteene hundred Ninety Seaven
       added to the Three bonds afd makes the sume Totall to be Fifty Thousd
       pounds Toba  Which is full agreed for purchase of the land and
       stock &c  Debated in the bill and answer of the said parties still reserveing
       to the said Forbes liberty hereafter to produce any other
       receipt for any other money at any other time paid by the said Forbes
       to the said Smith or his order on account of the said land &c
       Soe that we find that there is still due to ballance upon the Three
       bonds and the bill aforesaid Thirty Three Thousand one hundred Eighty
       nine pounds of Toba To be pd by the sd Forbes to the sd Smith

          Wee doe further reserve to the said Smith liberty to make it
       Manifest that besides the Three said bonds and bill there was a
       Fourth bond passed to the sd Smith by the said Forbes for Twelve
       Thousand ^five hundred^ pounds of Toba paya to the said Smith Anno 1698 Either
       by pduceing such a bond or good proofe from Declar on Record or
       otherwise as the Court of Chancery shall allow of  Witness our
       hands and Seales the day and year abovesd Signed and Sealed
       the day and year above sd p Thomas Tench John Hammond
      
       Which said report or the State of the Account betweene the said
       parties as aforesaid being Exhibitted into this Hono.ble Court
       It is orderd by the Court that the same be read as alsoe the bill
       Answer Repl and Dep.o and other things thereto relateing be read in
       Court which being read in Court and fully debated as well by the
       Councill for the Complt as for the Defend.t and the pleadings and
       Allegacons being agreed and debated on both sides before his Ex.cy
       and this Court  The Court tooke the same under theire Serious &
       Deliberate Consideracon  And upon theire further purusall of y.e
       Auditors report relateing to the State of the Account Case as afd
       The Court here doe order and decree that the said Alexander Forbes
       be Eased and goe quiett from all further trouble and Suites at
