       Utterly refused that Alsoe protesting if they were read there he would leave
       the Compa and accordingly did soe

                   The Deposition of Coll Edward Lloyd

       Saith I doe know Alexander Forbes Complt and Robert Smith Esq.r Defendant
       I doe remember that being at the house of M.rs Jane Hemsely at York Towne in
       Talbott County and in the porch of the said house where the above named Rob.t
       Smith Esq.r was Alsoe Sev.rall other Gents  And as well as I cann remember
       or call to mind it was about Three or four years agoe there the above named
       Alexander Forbes the Complt did require the aforesd Smith to make over
       some land that he had bought of him the quantity If I heard named doe not
       remember and produced writeings which he the sd Forbes called a Deed or
       Conveyance by way of Lease and release as he Termed it  Which the afd
       Forbes required the above named Smith to signe and acknowledge after
       some Communicacon betweene them uppon that matter Esq.r Smith said he
       would not signe that paper or to that purpose  The Complt Forbes desired him
       to read it but Esq.r Smith refused to read it Forbes further desired him to hear
       it read but Esq.r Smith replyd he would not read it nor hear it read declareing
       if any person did read it he would goe out of the Compa  And after
       publicacon hereof in this Hono.ble Court It was moved by the Complts sd
       Attorney that for as much as this Cause depends upon Stateing some matters
       and Accounts relateing to what is sett forth in the sd bill of Complt
   
       Therefore humbly prayes this Hono.ble Court that Comission to Auditors
       be awarded and directed to the Honoble Thomas Tench and John Hammond
       Esq.rs to Examine and State the Accounts of the said Complt with the said
       Defendant relateing to this Cause and to report the same under theire
       hands and Seales to this Court by all Convenient speed  Which the Defd.t
       Consented to was granted as prayd  Afterward (To witt) the Thirteenth
       day of October 1705 Came the Auditors aforesaid and made report
       under theire hands and Seales unto his Excell and this Hono.ble Court as
       Follows (Viz.t)  By virtue of an order to us directed from the High Court of
       Chancery to me directed dated the Twenty Second day of February last to Examine
       and State the Accounts betweene Alexander Forbes Complt and Robert
       Smith Esq.r Defendant touching a cause in the said Court Depending between
       the said parties   Wee doe upon strict inquire and Examination find y.t
       the sd Forbes payd to the said Smith and to his Order or to other persons
       by his order  The sume of Eleaven Thousand Eight Hundred & Eleaven
                                                                                                       pounds
