640) Decreed that the Defendant Lowe shall alsoe pay to the said Complt Forbes and the said Complts moderate Cost at law and Equity The Execucon of which said Decree of this Hono.ble Court was by order superseeded untill the next Court Att which said next Court to witt at a Court of Chancery held at Annapolis the Tenth day of October 1705 Present His Excellency the Governour Keeper &c Coll John Hammond Thomas Tench Esq.r Of the Hono.ble Councill Judges Assistant Robert Smith Esq.r And it was then moved by the Defendants Councill that because of the absence of M.r Plater (Councill for the Defendant) on the seaventh of May last the Court ordered that the sd Decree for the Complt be suspended and then Continued untill the next Court And orderd that the Cause be reheard the same Chancery Court At which said next Court held at Annapolis the Tenth day of May Anno Dm 1706 were present His Excellency Governour and Keeper &c William Holland and James Saunders Esq.rs of the Hono.ble Councill his Assistants Judges Then appeard the Complt and Defend.t by theire Councill a foresaid and mutuall Consent of both partyes this Cause was further Continued untill the seaventeenth instant and by the Court here orderd printoryly that the Cause be reheard pursuant to a former order of this Court Att a Court of Chancery held at Annapolis the seaventeenth day of May Anno 1706 Were present His Excell the Governour and Keeper &c William Holland James Saunders Esq.rs his Assistants |
