She was never sent to Choptanke after she went to Kent for
she was brought to Wye Towne and there rotted she lay some days
but how many cannot remember Edward Russell I heard was a
saylor but the rest I beleive was not As for Ralph Stevens
one of the Crew is generally very Timerous

To the sev.rall questions pposed by M.r Nicholas Lowe
Richard Bruffe answered upon his Oath as followes

I doe know both Complt and Defendant  she never was sent

I beleive she was capable of being carryed to Choptanke about
       a week

Edward Russell was accounted a saillor and the rest not

To the best of my remembrance there and a small Gust

To the best of my remembrance she did seeme to be serviceable
While the five man boat lay at Wye Towne before M.r Forbes had
her Russell would have had me assisted to steele her sailes and
rigging saying that they were pretty good and that a penny might
be made of them but I refused and they were not stole
All which sev.rall Answers and Depositions as well on behalfe of
the Complt as on behalfe of the Defendant were sev.rally made
Oath to before M.r Richard Tilghman by virtue of Comissions granted
him for that purpose as aforesaid

Upon which it was orderd that the aforesaid bill and answer be read a
gaine and that the foregoeing Depositions already published be read
which accordingly was read and heard and by the Court fully understood
and the agreements on both sides being fully Traversed and debated
by theire Councill and fully Argued as well on behalfe of the
Complt as the Defendant  The Court here find that the Depositions
of the Complt is of great weight and that the Complt ought to have
       releife in this Hono.ble Court

Therefore doe order and decree that the Complt be releived against
the Defendant in this Judgment at law and pay pay the said Defendant
only for the tyme that the shallope was actually serviceable to him
at the rate of five pounds tenn shillings p moneth which appears
by the oath of Anthony Rumball one of the Evidences only to be
Eight dayes in the Complts Service and noe more  And it is further
                                                                                        Decreed
