4.th   After the five man boat was brought to Wye Towne she was very
       leaky and sunck

9.th   She was soe leaky that she sunck

10.th   I doe not know whether she was serviceable or not

       The answer of Richard Austin to the sev.rall Interrogatoryes pposed
       by Alexander Forbes Complt against Nicholas Lowe Defd.t Aprill
       the Twelfth 1703 upon his oath said

1   I know both Complt and Defend.t

3.d   The five man boat was very leaky but she did carry her loading
       safe to Kent with great care and labour in pumping and comeing
       from Kent in a small Storme of Wind her foresayle was soe
       rotten that it tore to peices

5   She was loaden deepe but whether over loaden my Judgment does
       not informe me she did not receive any Damage that I knew
       of either in loading or unloading

6   M.r Forbes did very much importune Edward Russell and Ralph Stevens
       to carry the five man boat to Choptanke but they refused theire
       reasons I know not

7   M.r Forbes did give Edward Russell and Ralph Stevens money but
       upon what account I know not

8   She was very leaky but in noe danger of sincking because we kept her
       Cleare with reasonable pumping the fore saile was rotten and splitt
       to peices with a small gust of Wind but the maine saile held

10   The vessell was very leaky but with care and labour carryed her loading
       safe to Kent but whether fitt for service I know not being not
       skilled in such matters

12   The five man boat was very leaky soe that if we had not beene
       Carefull to pump her night and day she would have damnifyed her
       loading I and another was hired when the boat lay at Kennemonts
       landing but for what purpose I know not for my owne part I went
       by my then Masters orders and laboured as the rest of the Company
       Nihill

       Which said Deposition on on behalfe of the Complt being read it was
       orderd that the Deposition of on behalfe of the Defendant be likewise
       read which likewise follows in these words
