          Aprill 1703 upon his Oath said   I did know both
       plt and Defd.t   And some time before I was Employd
       by M.r Forbes to goe with him to Kent there was a vessell
       in Abbloes his Creeke which I suppose was in Cap.t Phillips
       service and had a great deale of water in her soe that she to
       be near sinking and afterwards I heard that it was the five
       man boat

       In my Judgment she was not fitt for service which lay out
       Kennimonts landing for she was very leaky and her sailes
       badd her running rigging tollerably good she had a Crappling
       Iron which I heard M.r Forbes gott of M.r Knowles and
       a boat which the said Forbes pcured in one voyage over
       to Kent the five man boat proved soe leaky that we were
       forct to pump once in two hours Constantly

       In one voyage to Kent the five man boat proved soe leaky
       being deep loaden that if badd weather had happened we     
       Expected better Security from our boat then in her

       In my Judgment she was not over loaden and did not as I know
       of receive any damage either in loading or unloading

       I did hear M.r Forbes importune Edward Russell and Ralph
       Stevens to goe with the five man boat to Choptanke but
       Ralph Stevens would not goe declareing that he would not
       venture his Life in her she was so Leaky

       The five man boat was very leaky the tyme that I was on
       board of her

       M.r Forbes did pay Russell and Stevens before they came
       away with the five man boat

       The five man boat was very leaky and the sayles so badd that
       the fore sayle splitt and became inserviceable

       All the tyme I was on board her she was unfitt for service in
       my Judgement               And further saith nothing

       The answer of Richard Bruffe to the interrogatoryes pposed by
       Alexander Forbes Complt v Nicholas Lowe Defendant the Twelfth
       day of Aprill 1703 upon his oath said

       I know both Complt and Defendant Untill
