573 Which was repûted to be y.e bounded Tree of Wades point all which the S.d Hollinsworth being then psent did Affirm to this Dep.t and fûrther said that he Lived Some Time on y.e other Side of y.e s.d Cove right opposite to y.e s.d Bounded Tree and y.t he Thoûght he Could have Shott a bullett into y.e s.d Tree from his Dwelling hoûse & this Dep.t saith that they y.e s.d James Mûrphey & Hûgh Sherwood did Caûse a Tree to be boûned as near as they Could to y.e place where y.e old Tree Stood att y.e Distance of Aboût twenty or Thirty feet from it And as to y.e Second Boûnded tree of y.e s.d Land This Dep.t Saith that at y.e Moûth of a Swampy Gully on the Bay Side y.e s.d George Collison and Another Evidence which he this Dep.t Cannot remember did Swear y.t a Marked pine Tree which then lay att y.e place Afd was repûted to be y.e Second Bounded Tree of y.e Tract of Land called Wades point and y.t they this Dep.t and y.e s.d James Mûrphey did order another pine Tree which Stood aboût thirty paces distant from y.e former w.ch is now there Standing to be boûned And further Saith not Sworn before ûs y.e 30.th Day of Aprile Anno Dom 1707 John Hawkins M.oos Warde Talbott Ss To his Excy Jn.o Seymoûr Esq.r Cap.t Grald & Gove.r in Chief in and over her Majestys province of Maryland and high Chancellor of y.e Same We y.e Subscribers being Aûthorized & Impowered by a Comission oût of y.e high Coûrt of Chancery bearing Date y.e 20.th Day of March in y.e Sixty Year of her Majesties Reign Annoq Domini 1706/7 to Examin (on behalf of Edw.d Leeds and Jn.o Leeds of this Coûnty of Talbott planters) Severall Evidences to prove the Bounded Trees of a Tract of Land Called Wades point doe humbly Certifie That by Virtue of y.e s.d Commission and pûrsûant to y.e Request of Edw.d and Jn.o Leeds we did Caûse Severall Evidences to be Sûmmoned viz Hûgh Sherwood Daniel Sherwood Ennion Williams Edw.d Hambletone W.m Ha^m^bleton Edw.d Elliot Sen.r W.m Leeds and Jn.o Sandsbûry to Appear before ûs att y.e Dwelling hoûse of Edw.d Leeds on y.e 30.th Day of Aprile then next following and at y.e Day and place afd y.e Severall Evidences before mentioned did Appear all (Except Daniel Sherwood who alledged y.t he had Earnest business Elsewhere and Coûld not come) and from thence (in order to Execûte the Aûthority by y.e s.d Commission to ûs Delegated) we did repair to y.e place where y.e first boûnded Tree of y.e s.d Land called Wades point was Sûpposed to Stand and did reqûire y.e Sever.ll Evidences there psent to Give their Depositions Concerning y.e pmisses which was refused by Ennion Williams and Jn.o Sandsbûry who being who being by ûs reqûired to render their reasons for so doing y.e s.d Ennion Williams made Answere y.t he was a party Concerned in y.e bounds of y.e s.d Land and was not by y.e Land obliedged to your Evidence |
