572 he had Severall times Worked under or About y.e s.d Tree; And that he this Dep.t did hear George Collison (who was Another y.e s.d Evidences) Say that he y.e s.d George had likewise Seen a bounded Tree upon a point at y.e moûth of a Cove And fûrther this Dep.t Saith y.t he did See a Tree bounded by In order of Cap.t James Mûrphey and M.r James Sherwood y.e then Comissrs aboût foûr or five yds distant from y.e place where y.e former Boûnded Tree was S.d to Stand And as to y.e Second boûnded Tree of y.e s.d Land he fûrther Saith y.t he hath Severall Times Seen a boûnded pine Tree att y.e Moûth of a Swampy Gûlly on y.e Bay Side and that he did hear Tho.s Mason & Jn.o Hollinsworth ûpon their Oaths declare y.t y.e s.d pine was repûted & deemed to be y.e Second bounded Tree of y.e s.d Land Called Wades point and y.e first Bounded Tree of a Tract of Land Called Haddon And further this Dept Saith y.t y.e Afd Commissrs did order another pine Tree to be bounded at y.e Distance of About thirty paces from y.e Ancient Tree which was according pformed and fûrther Saith not Sworn to before ûs y.e 30.th day of Aprile Anno Domini 1707 John Hawkins M.oos Warde Talbot Ss The Deposition of Hûgh Sherwood of Talbott County Gen.t Aged Seventy and five Years Saith That formerly this Dep.t and Cap.t James Sherwood of Talbott County Gen.t to take y.e Depositions of Several Evidences to prove the Bounded Trees of a Tract of Land called Wades point by Virtue of y.e s.d Commission at a time and place Pfixed did call before them Severall Evidences viz George Collinson Jn.o Hollinsworth and one other Evidence bût it So happened that y.e s.d Jn.o Hollinsworth did not Come at y.e time Appointed Two Evidences Appearing were Sworn And this Dep.t Saith y.t they did declare ûpon their Oaths that they had Severall times Seen a Bounded Oake Tree Standing ûpon a point at y.e Moûth of a Cove which was repûted and deemed to be y.e first Boûnded Tree of a Tract of Land Called Wades point And that one of y.e Evidences did Say (bût which it was this Dep.t cannot Remember) he had Severall times piped it under y.e Same Tree which Cove before mentioned this Dep.t Saith is y.e Cove at y.e head of which Ennion Williams now Lives And fûrther Saith y.t Some time after Cap.t Mûrphey did tell him this Dep.t y.t Jn.o Hollinsworth who was y.e other Evidence was Come to Give Evidence therein but this Dep.t being Sick was not Able to goe but y.t Afterwards Cap.t Mûrphey did tell this Dep.t to he had been w.th y.e s.d Jn.o Hollinsworth att y.e place where he this Dep.t and y.e s.d Mûrphey were w.th y.e other two Evidences and that he y.e s.d James Mûrphey had Sworn y.e s.d Jn.o Hollinsworth Concerning y.e s.d Boûnded Tree and that y.e s.d Hollinsworth ûpon his Oath had Said y.t there was a bounded Tree Standing att y.e Mouth of y.e Cove Agt which |
