(497) Return of the Commission and Depositions for Enfield Chase Edlington and Howartons Range for Coll.o Henry Ridgley Filed August the 30.th 1702 By Vertue of a Comission from the high Court of Chancery bearing date Tenth Day of August Anno Dni 1702 Comanding us thereby to call before us all such Evidences as Coll.o Henry Ridgley Shall think fitt This the 18.th day of August 1702 Then came before us Thomas Sprigg and Sam.ll Magrade Jn.o Boyd sen.r of Prince Georges County having his Corporall oath administred by Us laying one hand upon the Tree the other upon the Holy Evangelist did upon oath depose as followeth viz.t That a bounded white oake standing on the south side of a Branch Called the Marsh Branch otherwise the Live Oake Branch, it being a scrubby Tree and marked and marked with twelve Notches standing at the Head of a small Draught that Runns into the Main Branch leaning Eastward and the third Boyd saith that about seventeen or eighteen years ago being in Company with George Yeate the said Yeat told to the said Boyd that the above 3.d white oake was the first bounded Tree of a Tract of Land Out for Dennis Frie And allso came Rob.t Anderson Sen.r the same day and made oath upon the Holy Evangelists as follows viz.t that he having Occasion to know the first bounded Tree of a Tract of Land laid out for Jn.o Witings that y.e abovesd George Yeats told him that the above 2.d white oake was the first bounded Tree for a Tract of Land laid out for James White of Ann Arundel County and from y.e 3.d Tree he must run a Mile West and there he would find the first bounded Tree of the aboves.d Jn.o Welings and further the s.d Anderson saith that ab.t fifteen or sixteen years ago he gott Edw.d Batson to run the above said Course exactly at the Miles End he found a bounded Tree which is now blown down farther Hugh Riley at the same time made oath upon the Holy Evangelist that about twelve years ago y.t y.e aboves.d Tree was inputed to be the first bounded Tree for a Tract of Land called Eylington laid out for James White and on the possession of Gabriel Parrott and also the aboves.d Boyd went the same Day to another Tree it being a bounded white oake standing on the West Side of a great Marsh standing in Tho.s Taylers Paster it being a Scabey White Oake and leans Westward and y.e Deponant saith that there was no Notches in the aboves.d Tree at that time till Marine Duvall sen.r now of Prince Georges County cutt them in at the same time when Marine Duvall of Ann Arundel County decd goitt Cap.t Hanslip to devide the Land called Hourtons Range & Parrotts Thickett being the s.d Marine Duvall decd and Gabriell Parrott and Marine Duvall Sen.r of Prince Georges County doth declare as followeth, viz.t having one hand on the Tree and the other on the Holy Evangelist That y.e aboves.d Marine Duvall saith that at the Request of his Father Marine Duvall dec.d and by Order of Cap.t Hanslip he with his own hands cutt the Notches into the aboves.d Tree for the deviding Tree betwixt Marine Duvall dec.d & Gabriel Parrott it being about sixteen years ago |
