491 Point in the said Rozers Land When the said Coll.o Addison demanded of Cap.t Thompson whether he thought that to be the first bound Tree and begining of the aforesaid Tract of Land Who after having his oath duly adminstred by the Com.rs appointed did lay his hand on the bounded white Oake above Expressed and did there declare upon oath that he did really in his Conscience believe that to be the very Tree and being also asked by Coll.o Addison whether they crossed any swamp in Running the first Course did answer that they Run a Streight East North East Course neither travising nor crossing any swamp but but Run on firm dry Ground a little ascending to the second Tree being a White Oake and carrying us up the River about a Hundred Yards to the Northward to another Tree that is Notched on four sides w.ch had been shown him by M.r Rozer and W.m Clarkson and did there positively declare as he was upon his oath that that was none of the Tree but the White Oake that stands by the swamp side was the Tree he caused to be bounded for y.e beginning Tree of the said Land he being Confirmed thereto by the knowledge he had of the adjacent swamp and land so that if that was not the very Tree he was positive it did stand within Twenty or Twenty five paces of that Tree neither to the Northward Eastward nor Southward but if any way to the Westward nearer the River all w.ch he declared upon oath and further saith not the mark of Jn.o 8 Norris Jun.r June 23.d 1702 The Deposition of Cap.t George Thompson of S.t Mary's County aged sixty five years or thereabouts being taken at the beginning bounded Tree of two certain Tracts of Land the one Called Admireathorea belonging now to Notly Rozer Gent y.e s.d Rozer having timely notice given him to be there the said Tree by Cap.t George Thompson Three days before this day as allso a Tract of Land called S.t Elizabeths now belonging to Coll.o Jn.o Addison The s.d Thompson having first taken his oath before us by Vertue of a Comission out of the Chancery Office of this province to us directed under the seal of this province to Examin the said Thompson and all other Evidences touching the said bounds of the said two Tracts of Land bearing date the 20.th day of March 1701/2 the said Thompson laying his hand on a bounded white oake w.ch stands on the North side of an Ashen Swamp w.ch Swamp is the fourth Swamp on the River Side above a high point of land called the hollowing Point and w.ch swamp and Tree bears East 26.d South from the mouth of a Creek in Virginia shore now known to us by the Name of Wests Creek and doth solemnly declare on his Oath as afd in the p.rsence of Cap.t Rob.t Wade and M.r Jn.o Hawkins Com.rs Jn.o Norris sen.r Jn.o Norris Jun.r Jn.o Watkins Moses Jones Alexander Harbert Daniell Connell William Glover and Jn.o Middleton that he doth really and sincerely believe and absolutely judge That to be the very Tree he caused to be bounded for the first bounds of the aforesaid Land Called Admireathorea now belonging to M.r Notly Rozer and is allso the first bound Tree of Coll.o Jn.o Addisons Land called S.t Elizabeths he being Confirmed thereto by the knowledge |
