371) Depositions of Witnesses touching y.e bounds of Wyats Point for W Leeds Talbot ss By virtue of y.e inclosed Comission to us directed from y.e high Court of Chancery of this province of Maryland & in obedience to y.e Comand thereof after Notice given to all parties concerned or relating to said Tract or Tenement of Land called Wyats Point Cont 400 Acres of Land took y.e Depositions of John Hollinsworth George Colleson and Thomas Mason wch are annexed hereof & have bounded a white oak about four yards distance from y.e place where y.e Evidences made oath y.e former tree stood And y.t with 12 Notches & likewise bounded a Pine with twelve Notches in y.e Room of y.e other Pine w.ch y.e s.d pine being y.e second bounded tree by them related having fair Notches yet to be seen y.e s.d tree wch awe ordered in y.e room of y.e first about 18 yards back by Amiery Gully In witness thereof We have hereunto set our hands this eighth day of March Anno Domini 1696/7 James Murphey (loc) (sigil) Hugh Sherwood (loc) (sig) Talbot ss The Deposition of John Hollinsworth of y.e County aforesaid being sworn on y.e holy Evangelists did before us testifie & say y.t about 30 years ago lived opposit against y.e first bounded tree of a tract of Land called by y.e name of Wyats Point Cont 400 Acres as it was so then reputed by y.e Inhabitants & farthermore saith y.t y.e Land he then lived on began at y.e s.d tree of Wyats Point wch occasioned him to take y.e more Notice of y.e same Likewise he declared also y.t y.e bounded pine for y.e second bounded tree was alwaies reputed y.e second bounded tree And farther yo.r Deponent saith not Decemb.r y.e 5.th 1696 The Deposition of George Colleson sen.r of Talbot County Being examined & sworn before us on y.e holy Evangelists did declare upon y.e same y.t about 20 years ago living at Cap.t Will Leeds deceased he did at certain times see a certain tree or branch about y.e place where y.e aforesaid Hollingsworth shewed us where y.e former bounded tree stood as he himself had shewed us that & to say with some Notches on it but y.t he could not tell whether it was a bounded tree or no only y.t he heard Henry Clay say y.t Cap.t Leed did formerly run a Line from y.e s.d tree south in expectation of taking up Land That y.e s.d Clay pretended Right to & farther yo.r Depon.t saith not The |
