       Kersey y.e s.d Dare did allow him to seal on y.e s.d land on condition
       y.t if he should pay 5000.ℓ tob in 3 years time (viz.t)
       bright dry & clean tob & in such convenient places as this Deft
       should accept  And y.t then this Deft should make a good Conveyance
       (to be duly executed) of y.e s.d pcell of land to him the
       s.d Complt & by his heirs forever  Otherwise y.e s.d Complt was to
       remain upon y.e s.d land as Tenant to y.e s.d Deft during his
       pleasure at reasonable Rent for y.e same yearly from his first
       entrance during y.e pleasure of y.e s.d Deft but if y.e s.d 5000.ℓ
       tob was paid as afd then y.e s.d Complt to pay no rent at all
       And whereas y.e s.d Deft saith y.t the demanded at severall times
       payment of y.e s.d 5000.ℓ tob during y.e 3 years as afd & yet
       y.t y.e s.d Complt never shewed any good or well quallifed tob
       nor did ever tender y.e 5000.ℓ tob according to y.e Comunication
       afd (as in y.e bill is falsely suggested) nor pay any part
       thereof to y.e s.d deft either during y.e s.d 3 years or since save
       y.t about y.e end of y.e 3 years y.e s.d Complt did set up two wares
       for fish & mended one more for y.e s.d Deft to y.e value of
       1000 pds tob w.ch y.e s.d deft was willing to allow  And Whereas
       y.e s.d Deft conceives y.t he is not obliged by y.e Comunication afd
       to sell y.e s.d land on w.ch y.e s.d Complt hath lived 7 years &
       paid no Rent nor quit rent & enproved no more than by
       building thereon one twenty foot dwelling house & one 15
       foot Kitchin & some little fencing & (as y.e s.d Deft is
       informed) hath wasted much tymber & left it rolling on y.e
       ground  And whereas y.e s.d Deft therefore prayeth to be discharged
       with reasonable Cost & Charges in this behalf expended  This
       Hon.ble Court upon hearing y.e whole matter on both sides this 23.d
*see y.e bill   of August 1695 doth order & decree  That y.e s.d Land in dispute
    of Cost      shall be forthwith restored to y.e s.d M.r Dare y.e Deft  To have &
pag 310         to hold y.e same to him his heirs & assignes for ever  And y.t y.e s.d
       Deft be dissmisst with reasonable Cost  *And y.t y.e s.d Deft
       shall acquitt y.e Complt from y.e whole Rent & pay to y.e s.d
       Complt 1000 pds of tob for y.e 3 Wares afd  And likewise y.t
       y.e s.d Deft repay y.e s.d Complt five hundred sixty two pds
       of tob paid to the said Defend.t by John Sequence
