(232 way wellcondiconed Marchantable Tobacco in Caske at one intire payment att & upon the fourth day of Feb.ry w.ch should bee in the yeare of our Lord 1679 w.thout Fraud or Delay Then the said Deed to bee voyd and of Noe effect or Else to abide in full force and the said Comp.lt Delivered posession thereof to the deft accordingly as by the said Deed then produced did appeare and the said first day of Aprill the Comp.lt and deft accounted for all things betweene them and the Comp.lt gave to this deft a Release & discharge und.r his hand and Seale for the said sume of Eighteene thousand pounds of Tobacco and left the Deed of Sale of the goods and the Deed of Mortgage of the Lands w.th the deft for security of the Remaind.r was Due to him w.ch by account then made up did appeare to bee Twelve thousand six hundred & seaven pounds of Tobacco a Coppy of w.ch Account was to the said Answere annexed and the said deft further sayed that if the said Comp.lt would pay unto the Deft the Tobacco soe due unto him (that is to say) Twelve thousand six hundred and seaven pounds of Tobacco w.th his Damages for being out of all his Tobacco & Give him an absolute sale of the said six hundred Acres of Land Called Clayhamond and Overtowne w.thout any Reserve hee then was Ready and Willing to Deliver up unto him all the Papers in his hands aswell the sale of the Lands & goods as the Mortgage of the Lands w.th all bills bonds Papers and Receipts w.ch hee had in his hands touching and Concerning the same and Pay his Costs and Charges in this suite & the deft Never desired noe more then to bee paid what hee had Lent and Entrusted him with out of good will and to doe him a Kindnesse haveing Respect to the vallue of Tobacco at the time hee soe Lent and Disbursed the same for the use and by the Ord.r of the Comp.lt w.thout Intending or Designeing any advantage of the Comp.lt or to Ruine or Undoe him as by the bill was falsely suggested And w.th the Generall Traverse hee Concluded his Answere Likewise the said Thomas Taylor Henry Darnall and Thomas Truman Did by theire said Report ord.r Doome and Judgm.t Und.r theire hands Certifie to this Court and did Award Ord.r and Adjudge to the Effect Following Viz That in pursueance of the said Ord.r and Comission to them directed beareing date the three & Twentyeth day of March Anno Dom 1679 They mett at the time & (place |
