       thereof from the said Comp.lt to the deft and his heires for Ever
       for the said sume of Eighteen thousand pounds of Tobacco w.ch he
       Tendered to the said Comp.lt to seale & desired to make up accounts
       w.th him for the Remaind.r but the Comp.lt absolutely refused to seale
       the same or to Come to any account whereupon the deft was necessitated
       (for the Recovery of his Just right) to sue out the said Two Replevins
       and Comence the said Accon of Ejectm.t in the said bill Mentioned
       of w.ch the said Comp.lt haveing Notice did desire the said Deft to
       forbeare any further Proceeding upon the same assureing him that
       hee would Come to a just and faire Account & would on Demand
       Execute the Deed aforesaid and that hee would put the deft into
       the Quiet and peaceable posession of the said Land Called
       Clayhamond and Overtowne onely desired that there might bee a
       Clause of Redempcon thereof in the said Deed that if hee payd back
       the said Eighteene thousand pounds of Tobacco and Tenn thousand
       Pounds of Tobacco more for the Charge the deft should bee att in
       Building fenceing Clearing upon the same hee might Reposesse and
       Enjoy the same and upon Payment of what should afterwards
       appeare to bee due hee might have all his deeds Delivered up and
       Cancelled  And thereupon the Comp.lt by his Deed bearing date the
       first day of Ap.ll in the yeare of our Lord 1678 In Consid.racon of
       the said sume of Eighteene thousand pounds of tobacco the Receipt
       Whereof hee thereby Acknowledged Did give Grant alien bargaine
       Sell Enfeoffe & Confirme to the said deft his heires & assignes for
       Ever the said Tract of Land Called Clayhamond Containing three
       hundred and Fifty acres more or Lesse Lyeing on the East side of
       Petuxent River above Hunting Creek in the woods and all that other
       pcell of Land Called Overtowne thereunto adjoyning Containing
       Two hundred and Fifty acres more or lesse being part of the
       Eleaven hundred and seaventeene Acres w.th all and Every theire
       appurtenances & all deeds and Writeings Concerning the same w.th
       this Provisoe that if the Comp.lt his heires Executo.rs Adm.rs & assignes
       should pay and satisfie to the deft his Executo.rs adm.rs or assignes
       or any of them in some Convenient place in Hunting Creeke w.thin
       half a Mile of some Convenient Landing place there the full and Just
       sume of Twenty Eight thousand Pounds of good sound and Every
