(212 Two hundred pounds of Tobacco and after the Comp.lt had been put to great Charges att Lawe The said deft did pay seaverall sumes of Tobacco To seaverall of the said Credito.rs w.ch w.th what he p.rtended was due to himself for Fees Amounted to Tenn thousand nine hund.rd Ninety and Eight pounds of Tobacco Und.r p.rtence of w.ch sume of Tobacco soe due to him hee the said deft pswaded the said Comp.lt to make a Deed of Sale Conveyance or Mortgage to him the s.d deft for the Consid.racon aforesaid of all the defts psonall estate amounting to in houshold stuffe Cattle plate hoggs horses and other things to four score thousand pounds of Tobacco as by the same deed or Mortgage if the Comp.lt had the same to Produce might appeare To w.ch the Comp.lt was Overpswaded by the deft to signe seale and deliv.r w.thout takeing any Coppy thereof and the deft had then since Caused to bee Removed away from the Comp.lts plantacon of the Comp.lts psonall estate in Plate houshold stuffe Cattle and other things to the full Vallue of fourteene thousand pounds of Tobacco as the Comp.lt Could make appeare p.rtending to the Comp.lt the said Deed or Mortgage was Invallid in Lawe Unlesse hee was posessed of some part thereof And hee did further alleadge that hee fearing the deft might take advantage of the said Deed or Mortgage for passing away the whole psonall estate of the Comp.lts and that hee would Keepe and Detaine all those goods hee had Removed from the Comp.lts house and were in his Posession hee the said Comp.lt did about the Eighth day of March in the yeare of our Lord 1677 pay to the said deft Nine thousand Two hundred and fourteene pounds of Tobacco in Discharge of part of the said Tenn thousand nine hundred ninety and eight pounds of Tobacco Soe that there then Remained due due upon the said Mortgage onely seaventeene hundred Eighty and foure pounds of Tobacco to Redeeme the said psonall Estate but the Comp.lt Tooke use Receipt for paym.t of the same and yet the said deft Kept the said deed or Mortgage still on foot After w.ch the said Parker the Deft Und.rstanding the Complt to bee Indebted to the Lord Prop.ry of this Province in the sume of seaven thousand Thousand nine hundred and fifty pounds of Tobacco The said Deft told the Comp.lt that hee would voluntarily w.thout any Consideracon for the same Lend the Comp.lt the said sume of seaven Thousand nine hundred and fifty pds of Tobacco To pay and Discharge the said debt to the Lord Prop.ry w.ch the Comp.lt accepted off but noe sooner had the Comp.lt made use of (the |
