MUNICIPAL CHARTERS

Volume), Title - "Corporations-Municipal", Subtitle - "Home
Rule", to repeal and withdraw Charter Amendment Resolution
Number 1981 - 5, adopted by the Mayor and City Council of
Ocean City, Maryland on September 7, 1981 by Resolution
Number 10 prior to such Charter Amendment Resolution's
having become effective or become a part of the Charter of
Ocean City, Maryland, and to repeal and withdraw Charter
Amendment Resolution Number 1981-6, adopted by the Mayor and
City Council of Ocean City, Maryland, on September 21, 1981,
by Resolution Number 11, prior to such Charter Amendment
Resolution's having become effective or become a part of the
Charter of Ocean City, Maryland, and in lieu thereof, to
amend Section C-706 of the Charter of Ocean City (1972
Edition, as supplemented), Title VII - "Finances", Subtitle
"Appropriations", said Charter Section C-706 constituting
Section 188D of the Code of Public Local Laws of Worcester
County (1961 Edition, as amended, being Article 24 of the
Code of Public Local Laws of Maryland), by adding to the
title of said Section C-706 the words, "Supplementary
Appropriations; Emergencies and Unforeseen or Unanticipated
Occurrences", and by enacting new provisions to be added to
said Section C-706, authorizing the City Council, during any
fiscal year, by Resolution adopted by a favorable vote of
not less than two-thirds (2/3) of the total elected
membership of the Council, to make supplementary
appropriations from unexpended and unencumbered funds set
aside for contingencies in the Town's budget, from federal,
state or private grants which were not included in the
budget for the current fiscal year, from revenue received
from anticipated sources but in excess of budget estimates
therefor, and from revenues received or to be received from
sources not anticipated in the budget for the current fiscal
year, including, but not limited to, the proceeds from the
public or private (negotiated) sale of general obligation
bonds and bond anticipation notes authorized and issued
after the adoption of the budget for capital improvements,
capital projects and capital expenditures of any nature
whatsoever to be financed in whole or in part by such
general obligation bonds or bond anticipation notes, and the
proceeds from the public or private (negotiated) sale of tax
anticipation notes authorized and issued after the adoption
of the budget in accordance with the Charter of Ocean City,
Maryland; providing that the City Council, by Resolution
adopted by a favorable vote of not less than two-thirds
(2/3) of the total elected membership of the Council, and
containing a declaration and description of a public
emergency affecting health, welfare, property or safety, or
the occurrence of any circumstances, conditions or events in
whole or in part unforeseen or unanticipated at the time the
budget was adopted by the Council, may, to the extent that
there are no available unappropriated revenues to meet,
provide for or deal with such emergency or occurrence, by
the same or a similar Resolution or by Ordinance, in each
such case adopted by a favorable vote of not less than
two-thirds (2/3) of the total elected membership of the
Council, authorize the issuance by the Town, otherwise in
