other cause. Before the Director is removed from office he
shall be given a copy of the charges made against him and an
opportunity of being heard publicly in person or by counsel
in his own defense, upon not less than ten days' notice].

59.

(c) The executive head of each Division shall be
appointed by the Director of the Department, subject to the
approval of the President and the Speaker. Initially, each
holds his position on probationary status for one year,
subject during that period to dismissal by the Director,
with the approval of the President and the Speaker.
Thereafter, each executive head shall hold his office

indefinitely. He may be removed by the [Commissioner of

Personnel] DIRECTOR WITH THE JOINT APPROVAL OF THE PRESIDENT
OF THE SENATE OF MARYLAND AND THE SPEAKER OF THE HOUSE OF
DELEGATES OF MARYLAND, upon charges filed by the Director
and upon proof of inefficiency, neglect of duty, misconduct
in office, or other cause. Before an executive head is
removed from office he shall be given a copy of the charges
against him and an opportunity of being heard publicly in
person or by counsel in his own defense, upon not less than
ten days' notice.

(d)  (1) Other professional employees in the Department
shall be appointed by the respective executive heads of the
Divisions, subject to the approval of the Director.
Initially, each shall hold his position on probationary
status for one year, subject during that period to dismissal
by the Director. Thereafter, each of the other professional
employees shall hold his position indefinitely. When
promoted, an employee shall hold the new position on
probationary status for not longer than one year. If during
the probationary period the Director determines that the
employee's performance in the new position is unsatisfactory
the employee shall be removed from the new position and
reinstated to the position from which promoted. He may be
removed by the [Commissioner of Personnel] DIRECTOR WITH THE
JOINT APPROVAL OF THE PRESIDENT OF THE SENATE OF MARYLAND
AND THE SPEAKER OF THE HOUSE OF DELEGATES OF MARYLAND, upon
charges filed by the Director and upon proof of
inefficiency, neglect of duty, misconduct in office, or
other cause. Before he is removed from his position he
shall be given a copy of the charges against him and an
opportunity of being heard publicly in person or by counsel
in his defense, upon not less than ten days' notice.

(2) (I) EXCEPT FOR THE POSITIONS OF PROFESSIONAL
EMPLOYEES AND THOSE POSITIONS DESCRIBED IN SUBPARAGRAPH
(II), ALL OTHER ALL POSITIONS AUTHORIZED FOR THE DEPARTMENT
ARE UNCLASSIFIED POSITIONS.
