(II) WITH THE JOINT APPROVAL OF THE

PRESIDENT OF THE SENATE OF MARYLAND AND THE SPEAKER OF THE
HOUSE OF DELEGATES, THE DIRECTOR MAY DETERMINE THAT SOME OF
THESE POSITIONS ARE CLASSIFIED POSITIONS.

(III) ALL UNCLASSIFIED POSITIONS UNDER

THIS PARAGRAPH SHALL BE CONSIDERED TO BE LIKE PROFESSIONAL
POSITIONS AND ARE SUBJECT TO ALL OF THE PROVISIONS OF THIS
SUBSECTION APPLICABLE TO PROFESSIONAL EMPLOYEES.

(3) THE PRESIDENT AND SPEAKER MAY PROMULGATE

GUIDELINES, UPON THE REQUEST OF THE DIRECTOR, WHICH

SUPERSEDE THE PROVISIONS OF ARTICLE 33, SUBTITLE 28 OF THE
CODE. THE PROVISIONS OF SECTIONS 28-1 AND 28-2 OF ARTICLE 33
OF THE CODE DO NOT APPLY TO THE EMPLOYEES OF THE DEPARTMENT.
THE PRESIDENT AND SPEAKER, WITH THE CONCURRENCE OF THE
LEGISLATIVE POLICY COMMITTEE, MAY PROMULGATE GUIDELINES
WHICH REGULATE POLITICAL ACTIVITIES FOR THOSE EMPLOYEES.

(3) THE LEGISLATIVE POLICY COMMITTEE SHALL ADOPT
GUIDELINES NOT INCONSISTENT WITH LAW GOVERNING HIRING,
TENURE, PROMOTION, GRIEVANCE PROCEDURES, AND POLITICAL
ACTIVITY FOR ALL PROFESSIONAL AND NONPROFESSIONAL EMPLOYEES
OF THE DEPARTMENT.

(e) [All other regular employees of the Department are
members of the classified service of the State and subject
generally to the rights, duties, and procedures applicable
under Article 64A of the code, title "Merit System."

(f)] The Department may employ or engage the services
of such officers, employees, consultants, accountants, and
special assistants as provided in the budget from time to
time.

[(g)] (E) The Legislative Auditor, before entering
upon the duties of his office, shall be covered by a surety
bond in accordance with §§ 46 through 50 of Article 78A of
this Code. In the discretion of. the joint committee on
budget and audit, surety bonds may be required also from
other officers and employees in the Division of Audits and
from other officers and employees of the Department.

Article 64A - Merit System

9C.

[The positions of all librarians, research analysts,
clerks, secretaries, stenographers, and similar occupations]
POSITIONS in the State Department of Legislative Reference
and [the positions of all stenographers, secretaries,
clerks, and similar positions] in the Department Of Fiscal
-Services are [part of the classified service,
notwithstanding any provisions in § 3 of this] GOVERNED BY
article 40 OF THE CODE [or elsewhere].
