HARRY HUGHES, Governor                               1779

SUBPARAGRAPH (I) OF THIS PARAGRAPH, EXCLUSIVE OF ANY NEW
REVENUES DERIVED UNDER ARTICLE 56, § 136(I) OF THE CODE,
SHALL BE THE MINIMUM AMOUNT ALLOCATED OR APPROPRIATED TO THE
STATE HIGHWAY ADMINISTRATION IN FISCAL YEAR 1984 FOR THESE
PURPOSES, EXCLUSIVE OF ANY NEW REVENUES DERIVED UNDER
ARTICLE 56, § 136(I) OR (J) OF THE CODE. IN FISCAL YEARS
1983 AND 1984, ANY NEW REVENUES DERIVED UNDER ARTICLE 56, §
136(I) OR (J) OF THE CODE AND CREDITED TO THE TRANSPORTATION
TRUST FUND AS PROVIDED IN SUBPARAGRAPH (I) OF THIS PARAGRAPH
SHALL BE EXPENDED BY THE STATE HIGHWAY ADMINISTRATION IN
ADDITION TO THE MINIMUM ALLOCATION OR APPROPRIATION
DESCRIBED IN THIS SUBPARAGRAPH.

(II) (III) THE SECRETARY OF THE DEPARTMENT
SHALL SUBMIT TO THE LEGISLATIVE POLICY COMMITTEE AND THE
DEPARTMENT OF FISCAL SERVICES A REPORT:

1. PRIOR TO THE BEGINNING OF THE

1983 SESSION, DETAILING THE INTENDED USE OF THE ADDITIONAL
REVENUES RAISED FROM THE INCREASE" IN THE LICENSE TAX IN
FISCAL YEAR 1983;

2. PRIOR TO THE BEGINNING OF THE

1984 SESSION, DETAILING THE ACTUAL USE OF THE ADDITIONAL
REVENUES RAISED IN FISCAL YEAR 1983 AND THE INTENDED USE OF
THE ADDITIONAL REVENUES RAISED FROM THE INCREASE IN THE
LICENSE TAX IN FISCAL YEAR 1984; AND

3. PRIOR TO THE BEGINNING OF THE

1985 SESSION, DETAILING THE ACTUAL USE OF THE ADDITIONAL
REVENUES RAISED IN FISCAL YEAR 1984.

(a) (1) Subject to the authority of the Secretary and,
where applicable, the Maryland Transportation Authority, the
Administration has jurisdiction:

[(1)] (I) Consistent with the provisions of
Article 21, for planning, developing, constructing,
acquiring, financing, and operating the transit facilities
authorized by this title; and

[(2)] (II) Over the services performed by and the
rentals, rates, fees, fares, and other charges imposed for
the services performed by transit facilities owned or
controlled by the Administration.

(2) (I) FOR FISCAL YEAR 1983 AND EACH FISCAL
YEAR THEREAFTER, THE ADMINISTRATION SHALL ESTABLISH IN THE
BALTIMORE REGION BUS TRANSIT FARES AT RATES PROJECTED TO
RECOVER FROM SUCH FARES AND OTHER OPERATING REVENUES AT
LEAST 50 PERCENT OF THE TOTAL OPERATING COSTS FOR THE MASS
TRANSIT BUS SERVICES UNDER ITS JURISDICTION. IT IS THE
INTENT OF THE GENERAL ASSEMBLY THAT THE PROVISIONS OF THIS
