Chapter 13

AN EMERGENCY ACT to amend Subsection 9, of Section
11A-2, title "Definitions" of Chapter 11A, title
"Condominiums" to provide that after October 19, 1979, the
developer be the holder of a fee simple title in the real
property being developed into condominiums and to provide
for waivers of the requirements of this Act by the County
Executive under certain conditions.

Effective Date October 19, 1979.

Chapter 14

AN EMERGENCY ACT to amend Chapter 11A, title
"Condominiums of the Montgomery County Code, 1972, as
amended, by adding a new Section 11A-5A, title "Warranty to
Purchaser" to provide a one-year warranty of certain items
in the individual unit and a three-year warranty on
specified common elements of the project; to provide for
Executive Regulations to specify required content of these
warranties; to require notice of defect to sellers and
require expeditious suits; and to provide that certain
properties for which a notice of intent to convert had been
given prior to the effective date of the Act would be exempt
from its requirements.

Effective Date November 9, 1979.

Chapter 15

AN EMERGENCY ACT to amend Chapter 11A, title
"Condominiums" of the Montgomery County Code, 1972, as
amended, by adding a new Section 11A-5B, title "Leaseholds
Extending Beyond Notice to Terminate" to provide that
elderly or handicapped tenants whose leases would otherwise
terminate during the notice of intent to convert period
shall be extended for 360 days; and to provide that
properties for which a notice of intent to convert had been
given prior to the effective date of the Act would be exempt
from its requirements.

Effective Date November 9, 1979.
