COUNTY LOCAL LAWS

sewage disposal effluent directly or indirectly into the
ground surface, ground waters, surface waters, storm sewers,
or abandoned wells, or maintain or operate a sewage disposal
system in such a manner that it becomes a nuisance or is
offensive, dangerous or prejudicial to the public health, to
set forth certain penalties for violating the provisions of
this Chapter, and to provide for conflicts of law between
this Chapter and Article 43 of the Annotated Code of
Maryland 1957, as amended.

Effective Date February 25, 1979.

Chapter 47

AN ACT to amend Chapter 40, title "Real Property", of
the Montgomery County Code, 1972, as amended, by adding a
new Section 40-10A, title "Disclosure of Availability of
Sewage Disposal System" to Article III, title "Sale of Real
Property" to provide that all contracts for the sale of real
property located in the County shall contain certain
provisions; to provide that the property owner or his duly
authorized agent shall have the duty to dislcose to the
prospective purchaser whether the property is connected to,
or has been authorized for connection to, a public sewer
constructed on the property, and, if not, whether an
individual sewage disposal system has been approved by the
County for such property or whether the property has been
disapproved by the County for the installation of an
individual sewage disposal system; to provide that when the
purchaser of property on which the disposal system has been
or is to be installed received the copy of the record plat,
such purchaser shall indicate in writing that he has
reviewed the applicable record plat.

Effective Date February 25, 1979.

Chapter 48

AN ACT to amend Subsection 60-l(b), title "Bethesda
Parking Lot District", Section 60-1, title "Special taxing
areas continued; areas defined", Chapter 60, title "Parking
Lot Districts" of the Montgomery County Code, 1972, as
amended, to include within the Parking District a lot
located within the Bethesda Central Business District; and
to become effective on June 1, 1980.

Effective Date June 1, 1980.
