Chapter 46
AN ACT to amend Chapter 2, title "Administration", of
the Montgomery County Code 1972, as amended, by repealing
and reenacting with amendments Subsection 2-112(a)(11),
title "Appeals concerning construction of excreta disposal
plants", of Section 2-112, title "Powers, duties and
functions", of Article V, title "County Board of Appeals";
to provide for appeals concerning individual water supply
and sewage disposal systems; to amend Chapter 24, title
"Health and Sanitation", of the Montgomery County Code 1972,
as amended, by repealing in its entirety Article II, title
"Wells", Sections 24-11 through 24-21; to amend Chapter 36,
title "Pond, Well and Excavation Safety Standards", of the
Montgomery County Code 1972, as amended, by repealing and
reenacting with amendments Section 36-1, title
"Definitions", to delete the definition of "Abandoned well"
and to amend the definitions of "Artificial pond" and
"Excavation", and by repealing in its entirety Section 36-5,
titled "Abandoned wells to be filled or covered"; and by
re-titling the Chapter and renumbering the sections; to
amend Chapter 45, title "Sewers, Sewage Disposal and
Drainage", of the Montgomery County Code 1972, as amended by
repealing in their entirety, Sections 45-1 through 45-6 and
by retitling Article I, title "In General" and renumbering
Section 45-7, and by repealing in its entirety Article II
title "Excreta Disposal", Sections 45-8 through 45-18; and
to add a new Chapter 27A, title "Individual Water Supply and
Sewage Disposal Systems" to the Montgomery County Code 1972,
as amended, to provide for the legislative intent of this
Chapter, to define certain terms, to set forth that the
director, department of environmental protection shall be
responsible for the administration and enforcement of this
Chapter, to allow the County Executive to adopt or amend
written rules and regulations for this Chapter, to prohibit
any person to construct, alter or extend an individual waste
supply system or an individual sewage disposal system within
Montgomery County unless he holds a valid permit, to
prohibit any person to collect, transport and dispose of the
solid and liquid contents of chemical toilets, holding
tanks, septic tanks, seepage pits, and privies unless he
holds a valid permit, to allow permits to be issued by the
director, department of environmental protection upon
compliance by the applicant with provisions of this Chapter,
to permit the County Executive to adopt a schedule of fees
for such permits, to authorize the director, department of
environmental protection to make all necessary inspections
to determine compliance with this Chapter, to prohibit any
person to discharge or cause to be discharged, sewage or
