Chapter 5
AN ACT to amend Chapter 29, title "Landlord-Tenant
Relations," of the Montgomery County Code 1972, as amended,
by repealing and reenacting, with amendments, Section 29-11,
title "Officers; Meetings; Quorum; Voting," subsection (c)
of Section 29-24, title "Denial, revocation or suspension,"
Section 29-40, title "Commission hearing generally," Section
29-42, title "Commission action when violation of Chapter or
defective tenancy not found," and Section 29-43, title
"Commission action when violation of Chapter or defective
tenancy found," and by adding a new Section 29-14A, title
"Commission panels authorized; decisions; appeals," to
Chapter 29 of the Montgomery County Code 1972, as amended,
to follow immediately after Section 29-14 thereof to
authorize the designation of Commission panels of three to
hear and decide, under certain conditions, complaints or
appeals pending before the Commission; to provide quorum and
voting requirements for such panel; to provide for decisions
without further hearing by the full Commission in the event
of a tie vote due to the failure of a panel member to vote;
to provide for appeals from panel decisions to the Circuit
Court; and to make certain technical changes in conformance
with this Act.

Chapter 6
AN ACT to amend Chapter 35, title "Police" of the
Montgomery County Code 1972, as amended; by repealing and
reenacting with amendments, Section 35-1, 35-2, 35-3, 35-9,
35-10, 35-11, 35-12, and 35-13 of Article I, title "In
General", Chapter 35, title "Police" of the Montgomery
County Code 1972, as amended; to change the title of
superintendent of police to the title of director of police;
to provide that the director shall maintain contact with
supervisors on the scene of unusual occurrences; to provide
that the director shall refer charges against officers to
the office of internal affairs; to repeal the requirement of
the director maintaining certain books and records; to
repeal the provision providing for the recall of retired
police during emergencies; and Article III, title
"Regulations", Chapter 35, title "Police" of the Montgomery
County Code 1972, as amended; to repeal certain rules of
conduct and performance which are currently promulgated
within the department of the director of police.
Effective Date July 27, 1978.
