AN ACT concerning
Somerset County - Private Roads
FOR the purpose of permitting the Somerset County
Commissioners to maintain certain private roads.
BY repealing and reenacting, with amendments,
Article 25 — County Commissioners
Section 3(o)
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 25 — County Commissioners

(o) (1) To provide for grading, paving, regrading,
repaying, curbing, recurbing, or repairing any road or
sidewalk new or hereafter condemned, ceded, opened, widened,
extended or straightened as public property and for levying
for the cost thereof on the assessable basis of the county
or providing for the payment of the cost thereof from the
county's share of the State gasoline tax; and to provide for
establishing the office of county roads engineer, and
defining the duties and powers thereof.
(2) In Charles County the construction,
reconstruction and maintenance of county roads is performed
by the State Highway Administration as provided in §8—634 of
the Transportation Article, and the powers of the County
Commissioners, insofar as not governed by the provisions of
Title 8 of the Transportation Article, are controlled by the
provisions of §§ 280 through 290, inclusive, of the Code of
Public Local Laws of Charles County, as amended from time to
time, and not by the provisions of this subsection-
(3) IN SOMERSET COUNTY, THE COUNTY
COMMISSIONERS MAY GRADE, PAVE, REGRADE, REPAVE, CURB,
RECURB, REPAIR, OR RECONSTRUCT ANY PRIVATE ROAD THAT HAS
BEEN USED BY THE PUBLIC FOR 20 YEARS OR MORE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
