AN ACT concerning

(Senate Bill 1163)

Prince George's County State Highway Administration -
Property Acquisition

FOR

the purpose of requiring that before property is
acquired for a State highway system project in Prince
George's County, the State Highway Administration shall

afford the Prince George's County Executive and County

Council and, if applicable, the municipality in which

the property is located, advance of a certain public

hearing and prior to the obtainment of certain

appraisals and surveys, the State Highway

Administration shall notify certain local governing

bodies and municipalities, and provide them with an

opportunity to submit comments on the proposed
acquisition.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

8-305.

ANY COSTS OF ACQUISITION ARE INCURRED, THE ADMINISTRATION

SHALL:

(1) NOTIFY THE COUNTY EXECUTIVE AND COUNTY

COUNCIL OF PRINCE GEORGE'S COUNTY AND, IF THE PROPERTY IS

LOCATED WITHIN THE BOUNDARIES OF A MUNICIPALITY, THE

GOVERNING BODY OF THE MUNICIPALITY OF THE PROPOSAL TO

ACQUIRE THE PROPERTY AND THE PURPOSE FOR WHICH IT IS TO BE

ACQUIRED; AND

(2) GIVE THE COUNTY EXECUTIVE AND COUNTY

COUNCIL AND, IF APPLICABLE, THE GOVERNING BODY OF THE

MUNICIPALITY, AT LEAST 30 DAYS IN WHICH TO SUBMIT COMMENTS

ON THE PROPOSED ACQUISITION.

(F) UPON A PRELIMINARY DETERMINATION BY THE

ADMINISTRATION TO UNDERTAKE ACQUISITION OF ANY PROPERTY FOR

ANY PROJECT IN ADVANCE OF A PUBLIC HEARING ON THAT PROJECT
AT WHICH PROPOSED RIGHT-OF-WAY LINES ARE IDENTIFIED. AND

           (F) BEFORE THE ADMINISTRATION ENTERS INTO ANY

CONTRACT TO ACQUIRE ANY PROPERTY IN PRINCE GEORGE'S COUNTY

FOR ANY OF THE USES DESCRIBED IN SUBSECTION (B) AND BEFORE
