the "chairman of the State Roads Commission"
to exercise all powers of the Commission
except those vested in the regional members of
the Commission, is deleted as superfluous in
light of §8-202(b)(2)(i) of this subtitle
granting the same qualified authority to the
Administrator. See §8-211 of this subtitle,
which provides that the Administrator is the
Commission Chairman; see, also, §2-205 of this
article and its revisor's note.
As to the referenced authority of the
Secretary, generally, see Title 2, Subtitle 1
of this article; as to specific qualifications
on that authority with regard to the State
Roads Commission, see §2-103(f) and (g) of
this article.
As to the authority of the Maryland
Transportation Authority, see Title 4 of this
article. Its jurisdiction extends to highway
facilities financed by its revenue bonds.
As to the powers and duties vested in the
State Roads Commission, see Part II of this
subtitle, particularly §8-218.
As to subsection (b) of this section, the
General Assembly might consider adopting the
simpler approach taken by §5-203 of this
article, as to the State Aviation
Administration. See, also, §§ 6-203 (b) and
7—203(b) of this article and their revisor's
notes.
8-204. GENERAL POWERS AND DUTIES OF ADMINISTRATION.
(A) IN GENERAL.
IN ADDITION TO THE SPECIFIC POWERS GRANTED AND
DUTIES IMPOSED BY THIS TITLE, THE ADMINISTRATION HAS THE
POWERS AND DUTIES SET FORTH IN THIS SECTION.
REVISOR'S NOTE: This subsection is new language
derived without substantive change from Art.
89B, §7 (a) - except for the "catchall" clause
of that section, which now appears in
subsection (i) of this section.
The present requirement that the powers and
duties "be performed in accordance with...
law" is deleted as an unnecessary statement of
the obvious.
The present reference requiring prior approval
of the Secretary or the Maryland
Transportation Authority is deleted as
practically unnecessary in light of the
