8-203. MANAGEMENT AND CONTROL OF ADMINISTRATION.
(A) GENERAL EXERCISE OF POWERS AND DUTIES.
THE EXERCISE OF THE POWERS AND DUTIES OF THE
ADMINISTRATION IS SUBJECT TO THE AUTHORITY OF THE
SECRETARY AND, WHERE APPLICABLE, THE MARYLAND
TRANSPORTATION AUTHORITY.
(B) EXERCISE OF POWERS AND DUTIES SUBJECT TO PRIOR
APPROVAL.
BY REGULATION OR DIRECTIVE, THE SECRETARY OR, WHERE
APPLICABLE, THE MARYLAND TRANSPORTATION AUTHORITY MAY
REQUIRE THAT THE EXERCISE OF ANY POWER OR DUTY OF THE
ADMINISTRATION BE SUBJECT TO THE PRIOR APPROVAL OF THE
SECRETARY OR THE MARYLAND TRANSPORTATION AUTHORITY, AS
THE CASE MAY BE.
(C) EXCEPTION.
THIS SECTION DOES NOT APPLY TO THE POWERS AND DUTIES
VESTED IN THE STATE ROADS COMMISSION BY ARTICLE III, §40B
OF THE STATE CONSTITUTION.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 89B,
§3(c), the introductory clause to §3 (b), and
the parenthetical phrase in the first sentence
of §7(a).
It has been revised to conform to similar
provisions, in this article as to other
comparable units in the Department (see, e.g.,
§§6-203(a) and 12-103(b) of this article) and,
therefore, substitutes references to the
Administration, generally, for the present,
more limited references to the "chairman of
the State Roads Commission".
