REVISOR'S NOTE: This subsection presently appears as
Art. 1A, §1-109.
The present application of the definition to
the term "airport" is deleted as unnecessary
in light of the new definition of "airport" in
subsection (g) of this section; see revisor's
note to that subsection.
In this subsection, the phrase "useful or
designed for use" is substituted for
"necessary or useful" and "now in use or
hereafter designed for use" to conform with
the language of the various "facilities" -
definitions elsewhere in this article; see,
e.g. §§ 3-101(k) and 6-101 (d) of this
article.
In item (1) of this subsection, the present
references to a "modern" airport and to
"heliports and helipads" are deleted as
unnecessary and, as to the former, misleading.
In item (2) of this subsection, the words
"related activities" are substituted for the
overly broad "activities".
Also, the phrase "at any location within the
State" is deleted as inconsistent with the
first sentence of present Art. 1A, §7-703(a) -
now §5—404 of this title - and as otherwise
unnecessary.
The only other changes are in style.
As to use of this definition for financing
purposes, see, also, §3-101(b) of this
article.
(I) AIRPORT HAZARD.
"AIRPORT HAZARD" MEANS ANY STRUCTURE, TREE OR OTHER
VEGETATION, OR USE OF LAND THAT:
(1) OBSTRUCTS THE AIRSPACE REQUIRED FOR THE
LANDING OR TAKING OFF OF AIRCRAFT AT AN AIRPORT;
(2) IS HAZARDOUS TO THE LANDING OR TAKING OFF
OF AIRCRAFT AT AN AIRPORT; OR
(3) INTERFERES WITH COMMUNICATION BETWEEN AN
AIRPORT AND AIRCRAFT.

In this section and throughout this title, the
phrase "or other vegetation" is added as a
