(J) OPERATE AIRCRAFT.
"OPERATE AIRCRAFT" MEANS TO NAVIGATE, PILOT, OR
OTHERWISE USE AIRCRAFT IN THE AIR OR ON LAND OR WATER.
REVISOR'S NOTE: This subsection is new language
derived from the first sentence of Art. 1A,
§1-115.
The term "operation of aircraft", which
presently is identically defined as "operate
aircraft", is deleted as unnecessary since the
meaning of that variant necessarily would flow
from the definition of the verb "operate".
The general phrase "in the air or on land or
water" is substituted for the present "in the
airspace over this State or upon any airport
within this State". The latter is unduly
limited and inconsistent with usage of the
phrase elsewhere in present Art. 1A; see,
e.g., present Art. 1A, §10-1002 (now §5-1006
of this title) on reckless operation, which
refers to any operation in the air "or on the
ground or water" in this State.
The only other changes are in style.
The second sentence of present Art. 1A, §1—115
now appears as §5-1009 of this title.
(K) POLICE OFFICER.
"POLICE OFFICER" MEANS:
(1) ANY STATE AVIATION ADMINISTRATION POLICE
OFFICER; AND
(2) ANY OTHER STATE OR LOCAL OFFICER
AUTHORIZED TO MAKE ARRESTS FOR VIOLATIONS OF STATE OR
LOCAL LAWS.
REVISOR'S NOTE: This subsection is new language
added to clarify and conform present
references to persons "charged with the
enforcement of State and local laws" (see,
e.g., present Art. 1A, §10—1001(a), now
§5-1102 of this title) and to a "law
enforcement officer" (see, e.g., present Art.
1A, §6-602, now §5-1003 of this title). It is
patterned after the similar definition in
