In paragraph (2)(iv) of this subsection, the
words "acquisition" and "regulation" are added
for clarity and improved specificity.
The only other changes are in style.
(E) AIRCRAFT.
"AIRCRAFT" MEANS ANY DEVICE USED OR DESIGNED FOR
NAVIGATION OF OR FLIGHT IN THE AIR.
REVISOR'S NOTE: This subsection presently appears as
Art. 1A, §1-105.
The present phrase "now known, or hereafter
invented" is deleted as unnecessary since that
concept is implicit in the definition.
The only other changes are in style.
(F) AIR NAVIGATION FACILITY.
(1) "AIR NAVIGATION FACILITY" MEANS ANY
FACILITY THAT IS USED IN, AVAILABLE FOR USE IN, OR
DESIGNED FOR USE IN THE AID OF AIR NAVIGATION.
(2) "AIR NAVIGATION FACILITY" INCLUDES ANY
ONE OR MORE OR COMBINATION OF STRUCTURES, MECHANISMS,
LIGHTS, BEACONS, MARKERS, COMMUNICATION SYSTEMS, AND
OTHER INSTRUMENTALITIES OR DEVICES USEFUL OR DESIGNED FOR
USE AS AN AID OR CONSTITUTING AN ADVANTAGE OR CONVENIENCE
TO THE SAFE TAKING OFF, NAVIGATION, AND LANDING OF
AIRCRAFT OR THE SAFE AND EFFICIENT OPERATION OR
MAINTENANCE OF AN AIRPORT OR AIRPORT FACILITY.
REVISOR'S NOTE: This subsection presently appears as
Art. 1A, §1-108.
The present exclusion from the definition of
facilities "owned or operated by the United
States" is deleted as unnecessary.
In paragraph (2) of this subsection, the
phrase "useful or designed for use" is
substituted for "used or useful" to conform
with the language of the various "facilities"
- definitions elsewhere in this article; see,
e.g., §§ 3-101(k) and 6-101 (d) of this
article.
Also in paragraph (2), the term "airport
facility" is added to reflect the division of
the present, synonymously defined terms
"airport" and "airport facility"; in this
regard, see revisor's notes to the new
definitions of these terms in this section.
The only other changes are in style.
