       the Day before the Date of these presents and made between the said Richard Lee on
       the one part and the said Daniel Dulany and Lloyd Dulany on the other part and
       by virtue of the Statute for transferring of Uses into Possession To have and to hold
       the said Tracts or Parcels of Land and parts of Tracts or Parcels of Land and all and
       Singular other the premises herein before mentioned meant or intended to be hereby
       granted aliened released or confirmed and every part and parcel thereof with their
       and every of their Appurtenances unto the said Daniel Dulany and Lloyd Dulany their
       Heirs and Assigns Nevertheless to the Uses Intents and Purposes and upon and under
       the Trusts Provisoes Conditions Limitations and Agreements herein after mentioned
       declared and expressed          And it is declared and agreed by and between all
       the said parties to these presents and it is the true Intent and meaning of these
       presents and of the parties to the same that the said Several and respective Gifts
       Grants Bargained Sales Alienations and Releases herein before made or mentioned
       to be made to the said Daniel Dulany and Lloyd Dulany in manner and
       form above expressed are respectively made upon Trust and Confidence that
       in case the said James Russell the Father of the said Anne the wife of the
       said Philip Thomas Lee shall and do within the space of fifteen Kalender
       Months to be computed from the Date of these presents pay or secure to be paid
       to the said Philip Thomas Lee all such Sum and Sums of Money as the
       said Charles Grahame and Philip Richard Fendall or the Survivor of them
       shall by writing under his or their Hands adjudge declare and determine to be
       the true and real value of the Estate and Interest hereby conveyed transferred and
       Limitted to the said Philip Thomas Lee meant mentioned or intended so to be
       that then the said Daniel Dulany and Lloyd Dulany or the Survivor of them
       his and their respective Heirs Executors Administrators and Assigns shall
       from thenceforth stand and be seized respectively of and in the above mentioned
       Lands and Premises with their and every of their Appurtenances to the uses
       following (that is to say) of and in the said Tract or parcel of Land called Dan
       lying in Frederick County to the use of the said Philip Thomas Lee and his Heirs
       and also of and in the above mentioned Tracts or Parcels of Land called the Three
       Brothers part of Batten's Clifts part of Wakefield purchased by the said Richard Lee
       of the aforesaid Charles King also the said other part or parcel of Land purchased
       by the said Richard Lee of the aforesaid Charles King together with the said Tract
       or Parcel of Land called Lee's purchase or Lee's upper Tract to the use of the said
