100 Richard Lee for and during his natural Life and after his decease to the use of Grace Lee the wife of the said Richard Lee for and during her natural Life and after the decease of the said Grace Lee then as to one equal third part of the said last mentioned Tracts or Parcels of Land to the use of the said Philip Thomas Lee and Anne his wife during their Natural Lives and of the Heirs and Assigns of the said Philip Thomas Lee and as for and concerning the other two third parts of the said last mentioned Tracts or parcels of Land to the use of the said Philip Thomas Lee his Heirs and Assigns forever And as for and concerning the said Tracts or parcels of Land called Smith and the said Tracts or Parcels of Land purchased by the said Richard Lee of the aforesaid Thomas Hungerford and Richard Smith above mentioned with all and Singular their Appurtenances to the use of the said Richard Lee for and during the Term of his Natural Life and after his Decease as to one equal third part of the said three last mentioned Tracts or Parcels of Land to the use of the said Philip Thomas Lee and Anne his wife during their Natural Lives and of the Heirs and Assigns of the said Philip Thomas Lee and as to the other two third parts of the said three last mentioned Tracts or Parcels of Land to the use of the said Philip Thomas Lee his Heirs and Assigns forever Provided always and it is hereby further declared to be the true Intent and meaning of these presents and of the parties hereto that if the said James Russell shall not pay or secure to be paid unto the said Philip Thomas Lee within the Time herein before limitted all such sum and Sums of Money as the said Charles Grahame and Philip Richard Fendall or the Survivor of them shall by writing under his or their Hands adjudge declare and determine to be the true and real value of the Estate and Interest hereby Conveyed transferred and limitted to the said Philip Thomas Lee or meant mentioned or intended so to be that then this present Indenture and all and every Clause Covenant Trust Use and Limitation therein Contained shall be absolutely void and of no Effect and the whole and intire Estate in all and singular the Lands and Premises herein before mentioned shall be revested in the said Richard Lee in as full and Ample Manner as if this Indenture had not been made anything herein contained to the Contrary notwithstanding and it shall and may be Lawful to and for the said Richard Lee and his Heirs to enter ^into^ hold occupy possess and enjoy all and singular the said Lands and Premises as fully and effectually as if these presents had not been made or Executed (And) |
