486 his wife Barney Binox and Ann his wife George Childs and Hannah his wife James Madewell and Temperance his wife and Walter James and Mary his wife Do Hereby Bargain Sell Alien Release and Confirm to the said Joseph Ensor his Heirs and Assigns All that Tract or parcel of Land called Mount Pleasant lying and being in Baltimore County aforesaid and which was granted to a certain Nicholas Haile and contained by Patent One hundred and fifty acres more or less together with all and singular the premises and appurtenances thereunto belonging or in any wise appertaining To Have and to Hold the said Tract or parcel of Land and Premises unto the said Joseph Ensor his Heirs and Assigns To the only proper use and Behoof of the said Joseph Ensor his Heirs and Assigns forever To the intent and purpose that as in Virtue of these presents as of the Statute for transferring uses into Possession the said Joseph Ensor may be and become a good and perfect Tenant of the Freehold and Inheritance of the Land and premisses aforesaid with the appurtenances against one or more Common Recovery or Recoveries may be had executed and perfected as hereinafter is mentioned And for that intent and purpose it is agreed covenanted and concluded by and between all the parties to these presents that is shall and may be lawful to and for the said William Cooke to sue forth and prosecute his lordships Writ of Entry sur disseisn en le post returnable and to be returned before before [illegible] of the Provincial Court to be held at the City of Annapolis on the second Tuesday of April seventeen hundred and seventy three thereby demanding by apt and convenient Names Quantities and description the Tract and parcel of Land and premises [illegible] against the said Joseph Ensor to which said writ the said Joseph Ensor shall be gratis in his own proper person or by his Attorney thereunto Authorized and shall vouch to warrant the same premisses the said Thomas Cole Speagle and Rachel his wife Barney Binox and Ann his wife George Childs and Hannah his wife James Madewell and Temperance his wife and Walter James and Mary his wife who shall also appear gratis in their proper persons or by their attorney lawfully authorized and shall and will enter into the said warranty and vouch over to warrant the said Land and premisses the common vouchee of the same Court who shall thereupon appear and enter into the said warranty and after Imparlance make default so that Judgment shall and may be had and given thereupon for the said William Cooke to recover the same Land and premisses against the said Joseph Ensor And for the said Joseph Ensor to recover over in value against the said Thomas Cole Speagle and Rachel his wife Barney Binox and Ann his wife George Childs and Hannah his wife James Madewell and Temperance his wife and Walter James and Mary his wife and for the said Thomas Cole Speagle and Rachel his wife Barney Binox and Ann his wife George Childs and Hannah his wife James Madewell and Temperance his wife and Walter James and Mary his wife to recover in value against the Common vouchee and such further proceedings shall be therein [illegible] that |
