436 containing one hundred Acres more or less; And also all that other Part or parcel of Land being in the possession of the said Robert Darnall called and known by the Name of Pitchcroft; And all the Negroes, Horses, Cattle, sheep, Hogs, Houshold Goods, Furniture, and all the personal Chattels, of what kind or Nature soever which the said Charles Carroll Esquire now has or ought to have, in Virtue of a Deed of Indenture between Henry Darnall of Prince George's County Gentleman, and Henry Darnall the Younger Son and Heir of the said Henry Darnall [illegible] of the one part and Charles Carroll of the City of Annapolis Esquire of the other part the Deed bearing date the twenty second Day of April in the Year of our Lord One thousand seven hundred and sixty one Reference being thereunto had may more fully and clearly appear (saving two Negroes now in Dispute between the said Robert Darnall and a certain William Digges jun.r) To have and to hold all the above specified Lands with the Appurtenances and all the Negroes, Horses, Cattle, Sheep, Hogs, Houshold Furniture and personall Chattels of what Nature or kind soever (except as before excepted) which said Henry Darnall the Elder and Henry Darnall the Younger hath had or ought to have by Virtue of any Deed or Instrument of Writing heretofore made of what Kind or Nature soever unto him the said Robert Darnall his Heirs and Assigns for ever to his and their own proper Use and Behoof and to and for no other Use Intent or purpose whatsoever And the said Charles Carroll Esquire doth further covenant grant and agree to and with the said Robert Darnall his Heirs and Assigns that he the said Charles Carroll Esquire and his Heirs shall and will at the reasonable Request of the said Robert Darnall and his Heirs or his or their Council learned in the Law make and execute any other Act or Acts Deed or Deeds Conveyance or Conveyances for the better Assurance of the above granted premisses as they shall be advised devised or required provided such Deed or Deeds Conveyance or Conveyances contain no other than a special warranty In Witness whereof the said Charles Carroll Esquire hath hereunto set his Hand and affixed his seal the Day and Year first above written Signed sealed and delivered Cha Carroll (Seal) In the Presence of W Cooke Ben Ogle On the Back of the aforegoing Deed was thus Endorsed Received the day and year first within written of and from the within named Robert Darnall the sum of fifteen hundred pounds Sterling being the Consideration Money mentioned by him to be paid to me Witness Cha Carroll W Cooke Ben Ogle Maryland S.ct On the 6.th Day of March 1773 the within named Charles Carroll Esq.r personally appeared before me the Subscriber one of the Justices of the Provincial Court and acknowledged the within Instrument of writing to be his Act and Deed according to the true Intent and Meaning of the same Deed and the Act of Assembly in that Case made and provided Acknowledged before me Dan.l of S.t Tho.s Jenifer 8½ Sides Recorded the 8.th of March 1773 |
