383 The aforegoing Deed was thus endorsed Viz.t On the twenty fifth Day of September seventeen hundred and Seventy two Came the aforementioned John Rogers Benjamin Musgrove Barton Philpott and Martha his Wife and acknowledged the aforegoing Instrument of Writing to be their respective Act and Deed and the Land and Premisses therein mentioned with the Appurtenances and every part and parcell thereof to be the Right and Estate of the said Benjamin Musgrove and Barton Philpott according to the true Intent and Meaning of the same Writing and the Act of Assembly in such Case made and provided at the same Time the said Martha being by my ^me^ privately examined apart from and out of the Hearing of her said Husband declared She made the said Acknowledgment and joined in the said Instrument of Writing and relinquished all her Right and Title of in and to the said Land and premisses willingly and freely and without being induced thereto by Fears or Threats of or ill Usage by her said Husband or Fear of his Displeasure according to the Act of Assembly in such Case made and provided Before me one of his Lordships Justices of our provincial Court 9 sides J Hepburn Recorded the 25.th Day of September 1772 Ex.d This Indenture made the twenty sixth ^Day^ of September in the Year of our Lord one thousand seven hundred and Seventy two between Thomas Rutland of Ann Arundel County in the province of Maryland Gentleman of the one part and Edward Hale Son of Henry of Prince Georges County in the province aforesaid Gentleman of the other part Whereas Benjamin Welsh late of Ann Arundel County deceased was in his Life Time seized of and entitled unto part of a Tract of Parcel of Land lying and being in Ann Arundel County aforesaid near the Head of South River called and known by the Name of Arnold Grey amongst other Things by him the said Benjamin mortgaged to John Brice Esquire deceased and whereas the said Thomas Rutland having administered on the Estate of the said Benjamin Welsh did heretofore take up and redeem the said Mortgage and procure a Release thereof from the legal Representatives of the said John Brice as also a Release of the Equity of Redemption thereupon from John Welsh Heir at Law of the said Benjamin and whereas the said Thomas Rutland hath since laid off the third part of the said parcel of Land for Ann Welsh Widow and Relict of the said Benjamin and is now entitled to the Reversion thereof Now this Indenture witnesseth that the said Thomas Rutland for and in Consideration of the Sum of one hundred Pounds Sterling Money to him in Hand paid at or before the Ensealing and Delivery of these presents the Receipt whereof is hereby acknowledged and the said Edward Hall son of Henry his Executors and Administrators thereof and therefrom fully acquitted and disharged (hath) |
