       in and to or out of the aforesaid Tracts or Parcells of Land or either or any part of
      either of them  To have and to Hold the said Tracts or parcels of Land & every of
       them and all and Singular the Premises with their and each of their Rights
       Members and Appurtenances to him the said Thomas Hill Airey his Heirs and
       Assigns to the use and Behoof of him the sid Thomas Hill Airey his Heirs and
       Assigns for ever to the Intent and Purpose Nevertheless that the said Thomas
       Hill Airey may be and become perfect Tenant of the Freehold & Inheritance of
       all & Singular the aforesaid Premisses with the Appurtenances that a common
       Recovery may be had and suffered against him in such manner as is herein
       after mentioned and to that end and Purpose it is hereby Covenanted granted and
       Agreed by and between all the said Parties to these Presents that the said John
       Murray before the end of this September Provincial Court shall Prosecute & Sue
       out one or more Writ or Writs of Entry sur Desseisin enle Post at the Cost and
       Charge of  him the said Thomas Pitt against him the said Thomas Hill Airey
       whereby the said John Murray shall Demand against the said Thomas Hill Airey
       the aforesaid Several Tracts or parcels of Land and Premisses with their & every of
       their Appurtenances by such Name or Names Quantity Number or Content of
       Acres or other Certainties and Descriptions to ascertain the same as shall be
       thought apt and convenient to which Writ or Writs the said Thomas Hill
       Airey shall Appear gratis in his proper person or by his Attorney or Attornies
       Lawfully Authorized and shall Vouch to Warranty the Premisses the said Thomas
       Pitt who shall Likewise appear gratis in his Proper Person or by his Attorney
       or Attornies lawfully Authorized and shall and will Enter into the said Warranty
       and Vouch over to Warrant the same Premisses the Common Vouchee who shall
       thereupon appear and enter into the said Warranty and imparl and after
       Imparlance make Default and such other and further Proceedings shall be
       therein so that one or more good and perfect common Recovery or Recoveries with
       Double Voucher shall and may be had suffered perfected and Executed in all
       Things according to the Usual Form of common Recoveries with Double
       Voucher for Assurance of Land in such case used and accustomed And
       it is hereby further Covenanted Concluded granted Declared and Agreed by and
       between all the said Parties to these Presents that from & after the Suffering
       and perfecting the said Recovery or Recoveries as well these Presents and the
       Assurance hereby as also the Common Recovery or Recoveries so as aforesaid
       or in any other Manner to be had suffered and Perfected of the Lands and
       Premisses aforesd shall be and Enure and shall be Adjudged construed deemed
       and taken and are and were meant and intended and are hereby declared
       to be and Enure to the Recoveror or Recoverors in the said Recovery or Recoveries
       named or to be Named and he and they and his and their Heirs shall
       stand and be Seized of the Tracts or Parcels of Land aforesaid and Premisses
       and every part thereof to and for the only proper use and behoof of him the
       said Thomas Pitt his Heirs and Assigns for ever and to or for no other Use
       Intent or Purpose whatsoever In Testimony whereof the Parties to these Presents
       have hereunto Interchangeably set their Hands and Affixed their Seals the day
