Ex.d
       This Indenture made the twenty second Day of September seventeen hundred
       and Seventy two  Between William Chizum of Dorchester County Schoolmaster of
       the one Part and Caleb Smoot of Saint Marys County Planter of the other Part
       Witnesseth that the said William Chizum for the barring all Estates Tail and Remainders
       over of and in all that Tract or Parcell of plantable Land granted to
       John Baker on the twentieth of May seventeen hundred and twenty five called
       Backers Fancy otherwise called Bakers Fancy lying and being in Saint Mary's
       County aforesaid containing two hundred and three Acres of Land and for the Consideration
       of five Shillings Current Money to him in Hand paid the Receipt whereof
       he doth hereby acknowledge hath granted bargained and sold and by these presents
       doth grant bargain and Sell unto the aforesaid Caleb Smoot his Heirs and Assigns
       the aforementioned Tract of Land with the Appurtenances thereunto belonging to
       have and to hold the said Tract or Parcell of Land together with all and singular
       the Appurtenances thereunto belonging to the Use and Behoof of him the sid
       Caleb Smoot his Heirs and Assigns forever to the Intent and Purpose nevertheless
       that the said Caleb Smoot may be perfect Tenant of the Freehold and Inheritance
       of the aforesaid Tract of Land with the Appurtenances against whom a
       common Recovery of the said Lands may be had suffered and perfected in which said
       common Recovery it is agreed that a certain Samuel Chase shall be Demandant
       and the said Caleb Smoot shall be Tenant and that the said William Chizum be Vouchee
       and vouch over the common Vouchee after the Manner and Course of a Common
       Recovery for the Assurance of Lands and it is hereby further covenanted and agreed
       between the said Parties to these presents that the said Common Recovery to be
       suffered as aforesaid of the aforesaid premisses with the Appurtenances shall enure
