32 On the Back of the aforegoing Deed was thus Endorsed Viz.t September the 7.th 1770 Rec.d of the within Bernard ONiell the Sum of Six hundred Pounds Sterling Money being the Consideration within mention'd to be paid by him to us H Carroll Test John Briscoe R Barnhouse September the 7.th 1770 Then came before us the Subscribers two of his Lordships Justices of S.t Marys County the aforenamed Henry Carroll and Araminta his Wife & Acknowledged the within Instrument of Writing to be their Act & Deed and the Land & Premisses therein Specified to be the Right and Estate of the aforenamed Bernard ONiell his Heirs & Assigns according to the true Intent & meaning of the said Deed Also Araminta the wife of him the said Henry Carroll being by us privately Examin'd apart from & out of the hearing of the said Husband did repeat as above and at the same time did Declare that she made this Acknowledgement of her own Voluntary free Will and Accord without threats or Compulsion from her said Husband or fear of his Displeasure R Barnhouse Recorded 12.th September 1770 John Briscoe 6 sides x.d This Indenture made the Eighth day of September in the Year of our Lord God one Thousand seven hundred and Seventy Between Bernard ONeill of S.t Marys County in the Province of Maryland Merch.t of the one part and Captain Henry Carroll of the County and Province aforesaid Gent.s of the other part Witnesseth that the said Bernard ONeill for and in Consideration of the Sum of Six Hundred Pounds Sterling Money by the said Henry Carroll to the said Bernard ONeill in hand paid or secured to be paid the Receipt of which he doth Acknowledge Has granted bargained and Sold and by these Presents doe grant & Bargain & Sell unto the said Henry Carroll one Tract of Land in S.t Marys County Joyning to and on the South side of Patuxent River called Farther Neck containing one hundred Acres more or Less also one Moiety of a Tract of Land in S.t Marys County and on the South side of the River Patuxent Containing Three hundred Acres called Smiths Discovery that is to say that half of the aforesaid Tract of Land that Lies Nearest & Joyns Pyny Hill River with all the Profits Buildings and Improvements thereunto Appartaining To have and to Hold all and Singular his the said Bernard ONeill's Right to the said Lands and Premises to him the said Henry Carroll his Heirs and Assigns for ever and the said Bernard ONiell doth hereby Covenant and Agree with the said Henry Carroll his Heirs & Assigns that he at the Time of Insealing and Delivering of these Presents that he has a good Right and Lawfull Authority to Sell and Convey the aforesaid lands with the Appurtenances and the said Henry Carroll his Heirs & Assigns shall and may for ever hereafter have hold and Peaceably Possess and Enjoy the said Lands and Premisses by him the said Bernard ONeill hereby Sold or intended to be Sold without any Interruption or Hinderance of him the said Bernard ONeill his Heirs Execut.s Adminis.s or Assigns and that the said is free and clear from all Incumbrances whatsoever In Witness whereof the said Bernard ONeill hath hereunto set his hand and Seal the day and Year above Written Sealed & Delivered In the second Line the Word Merch.t in Presence of us & in the last Line the Word said R Barnhouse were Interlined before Signed and John Briscoe Sealed Bernard O Neill (seal) |
