31 Be it remembered that the within Named Charles Grahame Came before me one of his Lordships the Lord Proprietarys Justices of the Provincial Court & Acknowledged the within Deed to be the Act of the within Named Lancelot Lee and the Lands and Premisses with their Appurtenances therein mentioned to be the Estate of the within named James Russell for the Uses Intents & Purposes within mentioned Taken Certified this 25.th day of August in the Year of our Lord one Thousand seven hundred and seventy Philip Thomas Lee I Hereby Certify that on the Twenty third Day of August one Thousand seven hundred and Seventy Joshua Lynch personally appeared before me the Subscriber one of his Lordships the Lord Proprietarys Justices of the Provincial Court and made Oath on the Holy Evangelists of Almighty God that he saw the within named Lancelot Lee Execute Sign Seal and Deliver the within Deed as his Act & Deed The said Joshua Lynch also made Oath that he saw the other Subscribing Witness Phil R.d Francis Lee Witness & Sign the Same Philip Thomas Lee Recorded 10.th September 1770 12 sides x.d This Indenture made the seventh day of September in the year of our Lord God one Thousand seven hundred & seventy Between Capt Henry Carroll of S.t Marys County in the Province of Maryland and Araminta his Wife of the one part and Bernard ONeill Merch.t of the other part Witnesseth that the said Henry Carroll & Araminta his Wife for and in Consideration of the Sum of Six Hundred Pounds Sterling ^money^ by the said Bernard ONeill to the said Henry and Araminta Carroll in hand paid or securd to be paid the Rec.t of which they acknowledge Have granted bargained and Sold and by these Presents doe grant and bargain and Sell unto the said Bernard ONiell one Tract of Land in S.t Marys County Joyning to and on the South side of Patuxent River call'd Farther Neck containing one hundred Acres more or Less also one Moiety of a Tract of land in S.t Marys County and on the South side of Patuxent River containing Three Hundred Acres called Smiths Discovery that is to say that half or equal part of the aforesaid Tract of Land that Lies Nearest and Joynes Piny Hill River with all Profits Buildings & Improvements thereunto Appartaining To have and to Hold all and Singular their the said Henry Carroll and Araminta his wifes Right to the said Lands and Premisses to him the said Bernard ONiell his Heirs and Assigns forever and the said Henry Carroll and Araminta his wife doth hereby Covenant and Agree with the said Bernard ONiell his Heirs and Assigns that they have at the Time of insealing and Delivery of these Presents a good Right & Lawfull Authority to Sell and Convey the afsd Lands with the Appurtenances And that the said Bernard ONiell his Heirs and Assigns shall and may for ever hereafter have hold & Peaceably Possess and Enjoy the same Lands and Premisses by them the sid Henry Carroll and Araminta hereby sold or intended to be Sold without any Interruption or Hinderance of him the said Henry Carroll and Araminta or either of them or their Heirs Exec.rs Administra.s or Assigns & that the same is free and Clear from all Incumbrance whatsoever the Rents to the Lord Proprietary only Excepted In Witness whereof the said Henry and Araminta hath hereunto set their hands & Seales the day & Year above written In the third Line the Word Merch.t in the H Carroll (seal) Sealed & Delivered Eighth Line the words containing Three in the Presence of us hundred acres were interlined before signed R Barnhouse & sealed Araminta Carroll (Seal) John Briscoe |
