(65) and against all manner of persons claiming from by or under him the said Jacob Fowler or his heirs Provided always and these presents are upon this condition That if he the said Jacob Fowler his Heirs Executors Administrators or Assigns do & Shall well & truly pay or cause to be paid unto the said Henry Hall or to his Executors Administrators or Assigns the afs.d sum of Sixty Three pounds eleven shillings & eleven pence St.g With Legal Interest thereon for Redemption of the said Bargained premisses on or before the first day of December next Ensuing the date hereof Then & in Such Case this present indenture & every clause, article & thing herein contained shall cease determine & become absolutely void any thing herein Before mentioned or contained to the contrary thereof in any wise notwithstanding And the said Jacob Fowler for himself his Heirs Executors & Administrators doth hereby covenant promise grant & agree to & with the said Henry Hall, his Executors Administrators & Assigns That he the said Jacob Fowler his Heirs Executors Administrators or Assigns shall & will well & truly pay or cause to be paid unto the said Henry Hall his Executors Administrators or Assigns the Afs.d Sum of Sixty Three pounds Eleven shillings & eleven pence sterling money with Legal Interest thereon on or before the first day of December next ensuing the date hereof according to the true meaning of the proviso or condition herein before contained for and in Redemption of the premisses In Witness whereof I the said Jacob Fowler have hereunto set my hand and seal the day and year first above Written sign'd sealed and Delivered in the presence of Jacob Fowler (seal) Jn.o Brice R.d Henderson On the Back of the Aforegoing Deed was thus Written Viz.t October 31.st 1765 Then Received of Henry Hall the sum of £63 11 11 sterling it being the within consideration £63 11 11 St.g Jacob Fowler Jn.o Brice R.d Henderson On the 31.st day of October 1765 Came Jacob Fowler before me the subscriber one of his Lordships Justices for the provincial court and acknowledged the Within Instrument to be his act and deed and the premises therein mentioned to be the Right & Estate of the within named Henry Hall his (Heirs) |
