(617) Court to sue forth and Prosecute against him the said Thomas Stone one writ of Entry Sur disseisin en lepost returnable before the Lord Proprietarys Justices of the said Provincial Court thereby Demanding against the said Thomas Stone the said tract or parcell of Land and Premises with the Appurtenances herein before mentioned by such name or Names Number of Acres Quality and Description in the said writ to be Contained and in such Manner and form as by Council Learned in the Law shall be Advised unto which said writ of Entry so to be Prosecuted and sued forth the said Thomas Stone shall appear Gratis either in his Proper person or by his Attorney lawfully Authorized and shall vouch to warranty the said Margaret Brown and Gustavus Richard Brown who shall appear Gratis either in Proper Persons or by Attorney or Attorneys lawfully authorized and enter into warranty ^and after ^their^ Entring into Warranty^ shall vouch the Common Vouchee who shall likewise Appear and imparl and afterwards make Default and Depart in Contempt of the Court aforesaid so that Judgment may be thereupon had and Given for the said Frederick Stone to recover the said Tract of Land and Premises with the Appurtenances against the said Thomas Stone and for the said Thomas Stone to recover in Value against the said Margaret Brown & Gustavus Richard Brown and for the said margaret Brown & Gustavus Richard Brown to recover in Value against the Common Vouchee To the end intent and Purpose that one Compleat and Perfect Common recovery with Double Voucher may be then & there had and sufferred and all and every Necessary necessary thing and things done and Perfected according to the Course of Common Recoveries in such Cases used And the same Recovery to be Executed by one writ of Hebere facias seisinam according And it is hereby Covenanted concluded and agreed by and between all the Parties to these Presents themselves and their heirs Respectively that the said recovery so as aforesaid or in any other manner to be had and sufferred of the said Tract or parcell of Land with the Appurtenances and premises shall be and Enure and shall be deemed adjudged and taken and is meant intended and agreed by all the parties to these presents to be and enure to the said Margaret Brown for and during her Natural Life and after the Decease of her the said Margarett Brown to be and enure to the use and behoof of him the said Gustavus Richard Brown his heirs and Assigns forever And the said Thomas Stone from and immediately after the said Common Recovery is had and Sufferred shall stand and be seised of the said tract or parcell of land and Premises with the Appurtenances so as aforesaid bargained and sold and every part and Parcell thereof to and for the only proper use and behoofe of her the said Margaret Brown during her Natural Life Remainder to him the said Gustavus Richard (Brown) |
