(579) the whole being 130¼ Acres of Land more or less being or lying at the Head of South river in Ann Arundel County together with all houses Buildings Gardens Orchards ways woods underwoods waters water course Profits privaledges Advantages and appurtenances whatsoever to the said Tracts or parcels of Land and each of them belonging or in any wise appurtaining and the reversion and reversions Remainder and remainders Rents Issues and Profits of the same Tracts or parcels of Land and each of them and every part and parcel thereof and all the Estate Right Title Interest Use Possession property Claim and Demand whatsoever of him the said John Wilmot of into or out of the said Tracts or parcels of Land and each of them and every part or parcel thereof and he the said John Wilmot for the purpose and upon and for the Consideration aforesaid he hath also given granted Bargained Sold and Delivered and by these presents doth Give Grant Bargain Sell and Deliver unto them unto the said Nicholas Maccubbin and James Dick their Heirs Executors Administrators or Assigns all and each and every of the Servants and Slaves of him the said John Wilmot herein after mentioned viz.t Negro Phillis, Baudley, Jacob, Rachel James and Ned To have and to hold the above named Tracts and parcels of Land and every part and parcel of them with their and each of their Rights Members and Appurtenances to them the said Nicholas Maccubbin and James Dick their Heirs and Assigns And to have and to hold the said Servants and Negro Slaves to them the said Nicholas Maccubbin and James Dick their Heirs Executors Administrators and Assigns in and upon the trust and Confidence Nevertheless that they the said Nicholas Maccubbin and James Dick their heirs Executors Administrators and Assignees shall and will as soon as Conveniently may be after the Execution of these presents and also after Convenient Public Notice thereof in the Gazette Set up and exposed to Sale by way of Public Vendue on the premises or at Annapolis all the said Lands and Slaves or such part thereof as may be Necessary in such proportions or parts as they the said Nicholas Maccubbin and James Dick their Heirs Executors Administrators or Assignees shall think Proper and the same Lands and Slaves or any part thereof so Set up at Vandue to Sell and the same so Sold to deliver make over and Convey to the respective purchaser or purchasers thereof and the monies arising by such Sale and Conveyance to receive and after the receipt thereof the same monies to apply in the first place to the payment Satisfaction and discharge of all Costs Charges and expences that they the said Nicholas Maccubbin and James Dick their heirs Executors Administrators or Assignees have been or Shall be put to by the Creation or execution of this Trust and the residue thereof shall remain in their own hands an pay and deliver over in or towards payment Satisfaction or Discharge of the several Sums of Money due to them the said Nicholas Maccubbin and James Dick John Hall James Dick and Thomas Richardson Nathan Hammond Richard Maccubbin and Samuel Gallaway according to the priority of their Several Judgments and in Case more Money shall arise by such Sale as aforesaid and shall be actually received by the said Nicholas Maccubbin and James Dick their Heirs Executors Administrators or Assignees than shall be Sufficient to Pay Satisfie and discharge the said (Cost) |
