(578) therein Specifyed to be the right and Estate of the within named William Hall his heirs and Assigns according to the true intent and meaning thereof also the said Sarah and Henrietta being by me privately examined Apart from and out of the hearing of their husbands did repeat as above and at the same time did declare that they made this Acknowledgment Willingly and freely without being induced thereto by fear or Threats of or Ill Usage from their said husbands or fear of their Displeasure taken before & Certified by recorded the 18.th day of June 1769 11½ sides J Hepburn x.d Maryland fs.t 20 sides This Indenture made the fourteenth Day of June one Thousand Seven hundred and Sixty nine Between John Wilmot of Ann Arundel County Planter of the one part and Nicholas Maccubbin and James Dick of said County Merchants of the Other Part Whereas the said John Wilmot is now Justly and truly indebted to the said Nicholas Maccubbin and James Dick and the Several Persons following viz.t John Hall James Dick and Thomas Richardson Nathan Hammond Richard Maccubbin and Samuel Gallaway Sundry Sums of Money in virtue of Judgments Obtained by them in the provincial and County Courts against him the said John Wilmot as by the said Several Judgments (reference being thereunto had) may more fully and at large appear Now This Indenture Witnesseth that the said John Wilmot for Securing the payment of the said Several Debts and Sums of Money to the said Nicholas Maccubbin and James Dick John Hall James Dick and Thomas Richardson Nathan Hammond Richard Maccubbin and Samuel Gallaway with Interest thereon accruing and Costs of Suit every one to be paid according to the priority of their Judgments and in Consideration of Five Shillings Sterling Money by them the said Nicholas Maccubbin and James Dick to the said John Wilmot in hand paid at or before the Sealing and Delivery of these presents the receipt he doth hereby acknowledge and thereof and therefrom doth release Acquit and discharge the said Nicholas Maccubbin and James Dick their Heirs Executors Administrators and Assigns and every of them by these presents hath Given Granted Bargained Sold Aliened Released Enfeoffed and Confirmed and by these presents doth Give Grant Bargain Sell Alin Release Enfeoff and Confirm unto them the said Nicholas Maccubbin and James Dick their heirs and Assigns forever all that Tract of Land called Dinah's Fancy containing two hundred and fifteen Acres of Land more or less lying and being in Frederick County also that Other Tract of Land called Dinahs Goodwill Containing Three hundred and fourteen Acres of Land more or Less also lying in Frederick County and also that Other Tract or Tracts of Land to John Wilmot Deceased on or about the twenty first Day of February Seventeen hundred and Fifty five for one hundred and twenty four and a half Acres more or less also part the afores.d Tract which was Conveyed to me on or about the 30.th November 1757 Containing five and three quarters Acres (the) |
