(577) devised together with the said Tract called Batchelors Choice to his Daughter Mary deceased in Tail Containing in the said part of Hopkins Choice thirty three Acres and one third part of an acre together with the houses Buildings and all Other Improvements to the same Tract and parcell of Land belonging or in any wise Appertaining and the Revertion and Revertions Remainder and Remainders Rents Issues and profits of the same and all the Estate Right and Title of them the said Martha Roundell John Cox and Sarah his wife Benjamin Skinner and Henrietta his wife and Mary Smith of into or out of the said Tract and parcel of Land and Premisses To have and to hold the said Tract of Land called Butchers Choice and the said parcell of Land called Hopkins Choice hereby bargained and Sold or intended so to be and Other the premisses with the Appurtenances unto him the said William Hall his heirs and Assigns forever to the intent and Purpose that he the said William Hall may become a Good and perfect Tenant of the freehold of all and Singular the said Lands Messuages and premisses with the appurtenances so as that a Common Recovery may be had and Suffered of the same in due form of Law and for that end and purpose it is Agreed by all the said parties to these presents that it shall and may be lawful at the next or some Subsequent Provincial Court to sue out one or more writts of Entry Sur Disseisin en le post against him the said William Hall in the name of some person as Common Demandant of and for the said Lands and premisses with the Appurtenances by such Apt and Convenient Names and Descriptions as may be thought requisite unto which said Writt the said William Hall Shall appear gratis in his proper person or by attorney lawfully Authorized and Shall vouch to warranty the said Martha Roundell John Cox and Sarah his Wife Benjamin Skinner and Henrietta his Wife and Mary Smith who shall also appear gratis in their Proper persons or by Attorney lawfull Authorized and enter into the said warranty and vouch over the Common vouchee and all such Other and further proceedings shall be had therein as are Usual and Necessary for Suffering and perfecting Common Recoverys for assurance of Lands and it is hereby declared by all the said parties to these presents and the true intent and meaning thereof is that the said Common recovery Suffered in manner aforesaid or in any Other Manner shall be and Enure to and for the use of him the said William Hall his heirs and assigns forever and to or for no Other Use intent or Purpose Whatsoever In WItness whereof the parties to these presents have hereunto Sett their Hands and Seals the Day and year first above written Martha Roundell (Seal) Signed Sealed and Delivered John Cox (Seal) in the presence of us Sarh Cox (Seal) J Hepburn Ben Skinner (Seal) John Harrison Henrietta Maria Skinner (Seal) |
