(537) these Presents and every Clause Covenant Proviso and Agreement herein Contained shall become and be held deemed and taken to be Nul Void and of no Effect to all Intents and Purposes as fully as if the Same had Never been made any thing herein before Contained to the Contrary notwithstanding and the said John Baily doth hereby for himself his heirs Executors and Administrators Covenant Promise grant and agree to and with the said Daniel Dulany his Executors Administrators and Assigns that he the said John Bailey his Heirs Executors and Administrators shall and will well and truly Pay or cause to be Paid unto the said Daniel Dulany his Executors Administrators or Assigns the aforesaid Sum of two hundred and fifty two Pounds Sterling with legal Interest for the Same at the time herein before for that Purpose Mentioned And the said John Baily doth further Covenant and grant that he the said John Baily now is the true lawfull and rightfull Owner of all and Singular the said Lands and Premisses and also the said Negroe Slaves above Mentioned and also that he the said John Bailey is lawfully and rightfully Seized in his Own Right of a good Sure Perfect Absolute and Indefeazible Estate of Innheritance in fee Simple of and in all and Singular the said Premisses above Mentioned with the Appurtenances without any Manner of Condition Mortgage Limitation of Use and Uses or Other Matter Cause or thing to alter Change Charge or determine the Same and also that he the said John Baily now hath good Rightfull Power and lawfull Authority in his Own Right to grant bargain Sell and Convey all and Singular the said Lands Negroes and Premisses above Mentioned with the Appurtenances unto the said Daniel Dulany his Heirs and Assigns forever according to the true Intent and Meaning of these Presents In Witness whereof the Parties to these Presents have hereunto Set their Hands and Seals the day and year first above written Signed Sealed and Delivered John Bailey (Seal) In the Presence of the word two being interlined in three Several Places after the word fifty and also the words Viz.t and all the Present & future Issue and Increase of the said Negroes being first interlined Witness Geo Steuart R Ghiselin On the Back of the aforegoing Deed was thus indorsed to wit Received the day and year first within Mentioned of and from the within Named Daniel Dually the Sum of two Hundred and fifty two Pounds Sterling being the Consideration Mentioned to be by him Paid to me TEst Geo Steuart R Ghiselin John Bailey (On) |
